I BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 T caching License of ) REVOCATION OF RIGHT 6 ) TO APPLY 7 FRED SCOTT MEYERS ) 8 9 On February 3, 2012, the Teacher Standards and Practices Commission (Commission) 10 issued a Notice of Opportunity for Hearing to Fred Scott Meyers (Meyers) in which the 1 1 Commission charged him with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584- 12 020-0040(4)(n) as it incorporates OAR 584-020-0010(5); and Gross Unfitness pursuant to 13 ORS 342.175(1)(c); OAR 584-020-0040(5)(d), because ORS 167.007- Prostitution (OAR 584- 14 020-0040(1)(kk)) is a crime listed in OAR 584-020-0040(1), and OAR 584-020-oo4o(5)(e). 15 The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7009 1410 0002 16 1925 3228 to the address on file with the Commission. The Notice of Opportunity of Hearing, 17 dated February 3, 2012, and signed by Victoria Chamberlain, Executive Director, stated: 18 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, l9 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 20 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 21 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 22 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 23 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 24 DISCIPLINE.” 25 26 Meyers did not request a hearing. The Commission, therefore, finds Meyers to be in 27 default and enters the following findings of fact, conclusions of law and order, based 0n the files 28 and records of the Commission concerning this matter. 29 FINDINGS OF FACT 3O 1. Meyers was initially licensed as a teacher in Oregon on July 2, 1974. His Standard Teaching 31 License, with endorsements in Basic General Business Education (020) and Standard 32 Marketing (024), was issued on October 25, 2005, and expired on August 18, 2011. Meyers 33 has not submitted application for renewal. Meyers’ last TSPC application in 2005 indicated 34 he had been working for the Forest Grove School District in 1979. 35 2. On August 31, 2006, Meyers pled guilty and was convicted of Prostitution (ORS 167.007) in 36 Multnomah County Circuit Court. Prostitution is a class A misdemeanor and is listed in the 37 mandatory crime list requiring revocation of one’s teaching license. Pursuant to OAR 584-020- 38 0040(1) the Commission will revoke the license 0f any educator who has been convicted of any of 39 the crimes listed in ORS 342.143, or the substantial equivalent of any of those crimes if convicted in 40 another jurisdiction. On January 18, 2009, Meyers was arrested by the Portland Police Department for Prostitution 2 Procurement, a local ordinance and an unclassified misdemeanor. On February 2, 2009, these 3 charges were dismissed. Review of the associated police report indicates Meyers did attempt to 4 solicit a prostitute . 5 CONCLUSIONS 0F LAW 6 Meyers’s 2006 conviction for prostitution as described in section two (2) above 7 constitutes gross unfitness pursuant to ORS 342.175(1)(c); OAR 584-020-004OI5Xd) 8 (Commission of an act list in OAR 584-020-0040(1)), because ORS 167.007- Prostitution (OAR 9 584-020-0040(1)(kk)) is a crime listed in OAR 584-020-oo4o(1).
