BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) STIPULATION OF FACTS AND Teaching License of ) FINAL ORDER OF REPRIMAND WILLIAM COONEY ) ' On or about February 20, 2009, the Teacher Standards and Practices Commission (Commission) received a report from the Grants Pass School District indicating that William Cooney used district computer systems to access sexually explicit materials. Mr. Cooney fully cooperated with the Commission's investigation. Afler review of the matters alleged, Mr. Cooney and the Commission agree that their respective interests, together with the public interest, are best served by a stipulation to certain facts, the imposition ofa Public Reprimand. This document sets forth the facts upon which the parties have agreed‘ and the stipulated sanction to be imposed. IVI'. Cooney stipulates that-there is sufficient evidence in the Commissions files and records to support the findings ot fact, conclusions of law, and order set forth below. By signing below, Mr. Cooney acknowledges, understands, stipulates, and agrees to the following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of fact, conclusions of Iaw, and order set forth below, and fully and finally waives all such rights and any rights to appeal or othenlvise challenge this Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to the public upon request by the Commission; fiii) this Stipulation and Final Order is contingent upon and subject to approval and adoptionby the Commission. lfthe Commission does not approve and adopt this Stipulationrzand Final Order, then neither Mr..Cooney nor the Commission are bound by the terms herein; (iv) he has fully read this stipulation and Final Order and understands it completely, (v) he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or representation has been made to induce him to sign this Stipulation and Final Oder; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with regard to his n'ghts thereto, or waives any and all rights to consult with an attorney prior to entering into the Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. STIPULATION 0F FACTS 1. The Commission has licensed Mr. Cooney since August 23, 1990. Mr. Cooney holds a Five-Year Career and Technical Education Teaching License valid October 21, 2008 through October 20, 2013 with an Endorsement in Manufacturing Technology. 2. In February 2009, the Grants Pass School District determined that Mr. Cooney had used a district owned computer in his classroom to access sexually explicit web sites‘ 3. This misconduct constitutes Gross Neglect of Duty. The Commission has authority to impose discipline in this matterunder ORS 342.120 through 342.430 and OAR Chapter 584. ORDER The Commission hereby adopts and incorporates herein the above findings of fact and imposes a Public Reprimand on William Cooney.
