1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) PUBLIC REPRIMAND 6 EDMUND THOMAS MENDELSSOHN ) 7 , 8 On September 14, 2010, the Teacher Standards and Practices Commission 9 (Commission) issued a Notice of Opportunity for Hearing to Edmund Thomas 10 Mendelssohn (Mendelssohn) in which the Commission charged him with Gross Neglect 11 of Duty pursuant to OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(5); 12 and OAR 584-020-0040(4)(g). The Notice was sent via U.S. First Class Mail and U.S. I 13 Certified Mail Receipt 7010 0290- 0001 6831 4381 to the address on file with the 14 Commission. The Certified mail returned unclaimed. The regular mail was not 15 returned and assumed received by Mendelssohn. The Notice of Opportunity of , 16 Hearing, dated September 14, 2010, and signed by Victoria Chamberlain, Executive 17 Director, stated: 18 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY 19 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 20 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 21 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF 22 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN 23 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR 24 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE." 25 26 Mendelssohn did not request a hearing. The Commission, therefore, finds 27 Mendelssohn to be in default and enters the following findings of fact, conclusions of 28 law and order, based on the files and records of the Commission concerning this matter. 29 FINDINGS OF FACT 30 1. Mendelssohn has been licensed as a teacher in Oregon since February 5, 1996. 31 His current Continuing Administrator License issued on January 26, 2007, 32 expires on March 25, 2012. During all relevant times, Mendelssohn worked in 33 the Springfield School District. Mendelssohn was observed by attendees at the game, as 4 well as law enforcement. All were of the opinion that Mendelssohn was 5 intoxicated. 6 CONCLUSIONS OF LAW 7 Edmund Thomas Mendelssohn‘s conduct as described in paragraph 2 above 8 constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) 9 as it incorporates OAR 584-020-0010(5) (Use professional judgment); OAR 584-020- 10 0040(4)(g) (Appearing on duty or at any district-sponsored activity while under the influence of 11 alcohol or any controlled substance).
