1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter 0f the ) STIPULATION OF FACTS AND 4 Educator License of ) FINAL ORDER OF REPRIMAN D 5 RODNEY F WILLIAMS ) AND PROBATION i73 On April 20, 2012, the Teacher Standards and Practices Commission 8 (Commission) received a report from the Ontario School District, and several patron 9 complaints, alleging professional misconduct on the part of licensed educator, Rodney F 1 0 Williams (Williams). 1 1 After review of the matters alleged, Williams and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition of a Public Reprimand and two years of probation. 14 This Order sets forth the facts upon which the parties have agreed and the 15 sanction to be imposed. Williams stipulates that there are sufficient facts contained in 16 the Commission’s files and records to support the findings of fact and conclusions of law 1 7 set forth below. In entering into this stipulation, Williams waives the right to a hearing 1 8 to contest the findings of fact, conclusions of law and order set forth below. 19 By signing below, Williams acknowledges, understands, stipulates, and agrees to 20 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 21 the findings of fact, conclusions of law, and order set forth below, and fully and finally 22 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 23 Facts and Final Order of Reprimand and Probation (Stipulation and Final Order); (ii) 24 this Stipulation and Final Order is a public document and disclosed to the public upon 25 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 26 subject to approval and adoption by the Commission. lf the Commission does not 27 approve and adopt this Stipulation and Final Order, then neither Williams nor the 28 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 29 Final Order, and understands it completely; (v) he voluntarily, without any force or 30 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 31 the Stipulated Final Order below; (vi) he states that no promise or representation has 32 been made to induce him to sign this Stipulation and Final Order; and (vii) he has 33 consulted with an attorney regarding this Stipulation and Final Order and has been fully 34 advised with regard to his rights thereto, or waives any and all rights to consult with an Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION - RODNEY F WILLIAMS 1 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 2 the Stipulated Final Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Williams since May 15, 2000. Williams's Initial II 5 Teaching License, with endorsements in Basic Mathematics (HS, ML), Biology 6 (HS, ML), Integrated Science (HS, ML) and Multiple Subjects (MIDLVL), issued 7 on May 16, 2010, was scheduled to expire on November 30, 2013. Williams made 8 timely application for renewal and his expiration was pended awaiting the final 9 outcome of the investigation. During all relevant times, Williams was employed 1O by the Ontario School District. 1 1 2. On or about March 15, 2012, the school counselor overheard two female students 12 talking about alleged inappropriate physical contact between Williams and a 13 female student (KB) that occurred on March 7, 2012. The school counselor then 14 reported the conversation to the school principal. Subsequent investigation 15 determined that after school on March 7, 2012, Williams met with student KB in 16 his classroom regarding her future on the track team. Williams advised KB that 17 she should consider leaving the team because of her injury. At the end of the 18 conversation, Williams rolled his chair close to KB, kissed his hand and placed it , 19 on KB‘s cheek. Williams later explained he did this as a show of sympathy. KB 20 was upset and shocked by Williams’ behavior, and she left the room. KB advised 1 21 investigators that she left Williams’s classroom visibly upset by Williams’ 22 behavior. KB met a student in the hallway who asked her what was wrong. KB 1 23 informed the student of Williams‘ actions. KB told investigators she went to the 24 locker room where she told other students about Williams’ behavior. KB advised 25 she called her mother to get a ride home. KB’s timeline and statements are 26 collaborated by school video surveillance, cell phone records, and student witness 27 statements. 28 IT IS SO STIPULATED: / i8 114 %/fl/ a; / 31 ' a n HQ r‘ - , Date 32 /%%’l ///1 44/11 211 M 341'c0ria C *- -- 1W , Executive Director Date 35 Teacher Standards and Practices Commission 36 maEIiMSSTIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION - RODNEY F 1 CONCLUSION OF LAW 2 The conduct described above constitutes gross neglect of duty in violation of ORS 3 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584-020-001o(5) (Use 4 professional judgment),OAR 584-020-0030(2)(b) (Skill in communicating with 5 administrators, students, stafl, parents and other patrons); and OAR 584-020- 6 0004o(4)(o) as it incorporates OAR 584-020-0035(1)(c)(D) (Honoring appropriate 7 adult boundaries with students in conduct and conversation at all times). 8 9 The Commission's authority to impose discipline in this matter is based upon 10 ORS 342.175. 1 1 ORDER 12 Based on the foregoing, the Commission hereby orders as follows: 13 1. The Commission adopts and incorporates herein the above findings of fact and 14 conclusions of law, and based thereon, imposes a Public Reprimand on 15 Rodney F. Williams’s educators license; 1 6 17 2. Williams is hereby placed on probation for a period of two (2) years from the date 18 this order is signed by the Commission subject to the following conditions: 19 a.
