1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION I OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) DEFAULT ORDER 5 DONALD ANTHONY CASH ) REVOKING LICENSE 6 ) 7 On September 26, 1996, the Teacher Standards and Practices Commission informed 8 Donald Anthony Cash that the Commission found sufficient evidence of violation of 9 Standards for Competent and Ethical Performance of Oregon Educators to warrant a 10 hearing regarding his inappropriate use of school district computer equipment t0 l 1 access inappropriate materials through the intemet and permitting students to review 12 obscene and nude pictures on the computer in his classroom at Pilot Rock High 13 School. The letter and Notice of Opportunity for Hearing was mailed U.S. First Class 14 and U. S. Certified Mail--Return Receipt Requested. The certified mail receipt #P 196 15 851 031 was returned as unclaimed. However, the U. S. First Class mail was not 16 returned to TSPC. On October 22, 1996, TSPC received a letter together with Cash’s l7 teaching license. The letter stated that Cash was relinquishing his license and 18 waiving his right to hearing. 19 FINDINGS OF FACT 20 1. Donald Anthony Cash holds a Standard Teaching License endorsed for 21 Technology Education and Manufacturing Technology valid from March 1 1, z ‘Z 1996 to April 3, 2001. 23 2. Cash submitted his resignation from a teaching position with Pilot Rock School 24 District during an investigation regarding allegations that he had accessed 25 inappropriate materials through the Internet on the school districts computer 26 equipment. 27 3. Cash permitted students at Pilot Rock High School to review obscene and nude 28 pictures on Cash‘s computer in his classroom at Pilot Rock High School. 29 4. Cash talked with students about the pictures and instructed students on 3O getting this type of material for themselves from the Internet. 31 ULTIMATE FINDINGS OF FACT 32 Donald Anthony Cash knowingly used school materials and equipment for personal purposes. 33 CONCLUSIONS OF LAW 34 Donald Anthony Cash's behavior violates the Standards for Competent and Ethical 35 Performance of Oregon Educators, OAR 584-20-040 and constitutes gross neglect of 36 duty. ‘, , PAGE 1--ORDER--DONALD ANTHONY CASH 1 ORDER 2 The Commission accepts the surrender and revokes the Oregon Standard Teaching 3 License #251516 valid for technology education and manufacturing technology and 4 issued from March 1 1, 1996 through April 3, 2001, for knowing and substantial 5 unauthorized use of school equipment for personal purposes and providing obscene 6 and nude materials to students.
