1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) AND FINAL ORDER OF 5 PETE RICHARD PIAZZA ) REVOCATION OF LICENSURE 3 On or about June 5, 2006, the Teacher Standards and Practices Commission 8 (Commission) received a report from a patron of the Grant School District, indicating that Pete 9 Piazza (Piazza) struck a student. 10 After review of the matters alleged, Mr. Piazza and the Commission agree that their 11 respective interests, together With the public interest, are best served by a stipulation to certain 12 facts and revocation of her teaching license, pursuant to ORS 342.175(3). 13 This Order sets forth the facts upon which the parties have stipulated and the sanction to 14 be imposed. Mr. Piazza stipulates that there are sufficient facts contained in the Commission's 15 files and records to support the findings of fact and conclusions of law set forth below. In 16 entering into this stipulation, Mr. Piazza waives the right to a hearing to contest the finding of 17 fact, conclusion of law and order set forth below. Mr. Piazza understands that the Commission 18 will revoke his right to apply for a teaching license for one year. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order, neither Mr. Piazza nor the 21 Commission are bound by these Stipulations and Mr. Piazza retains all rights to a hearing on 22 the allegations. 23 STIPULATION OF FACTS I 24 1. The Commission first licensed Mr. Piazza on July 22, 1996. Mr. Piazza’s Basic 25 Teaching License, with a Basic Social Studies endorsement, was issued May 23, 2006 and 26 expired May 22, 2009. Vernon Middle School wrestling team. On or about 2 February 21, 2004, following a students loss of a wrestling match Mr. Piazza yelled and pushed 3 the student more than once. 4 3. On or about April 25, 2006, during a track team practice at Grant Union High School 5 track field, Mr. Piazza struck a student who is also Mr. Piazza’s son, in the mouth and stomach, 6 with an open hand. 7 4. Mr. Piazza utilized school district computers to exchange sexually explicit images and 8 email messages with an adult female friend. 9 5. This conduct constitutes Gross Neglect of Duty in violation of OAR 584- 20 020-0040(4)(e). 21 Mr. Piazza struck a student, who was also his son, on school grounds as described in 22 paragraph 3 above. This conduct constituted Gross Neglect of Duty in violation of OAR 584- 23 020-0040(4)(d); OAR 584-020-0040(4)(n) as it incorporates OAR 594-020-0010(5). 24 Mr. Piazza used a school district computer to send and receive sexually explicit material 25 as described in paragraph 4 above. This conduct constitutes Gross Neglect of Duty in violation 26 of OAR 584-020-0040(4)(q). The Commission's authority to impose discipline in this matter is 27 based upon ORS 342.175.
