9 On October 4, 2011, the Teacher Standards and Practices Commission (Commission) issued a
10 Notice of Opportunity for Hearing to Richard Wayne Knode (Knode) in which the Commission denied
11 reinstatement of his teaching license. The Notice was sent via U.S. First Class Mail and U.S. Certified
12 Mail Receipt 7010 2780 0000 2187 7116 to the address on file with the Commission. The certified
13 mail was signed for on October ll, 2011. The Notice of Opportunity of Hearing, dated October 4,
14 2011, and signed by Victoria Chamberlain, Executive Director, stated:

16 "You, Richard Wayne Knode, are entitled to a hearing on the proposed action of the
l7 Commission. If you want a hearing, you must file a written request for a hearing with
18 the Commission within 60 days of the date of this notice. Attached to this notice is a
19 copy of the procedures, right of representation and other rights of parties relating to the
20 conduct ofa hearing as required under ORS 183.4l3(2)”

22 Knode did not request a hearing. The Commission, therefore, finds Knode to be in default and
23 enters the following findings of fact, conclusions of law and order, based on the files and
24 records of the Commission concerning this matter.

26 FINDINGS OF FACT

28 l. On 0r about January 21, 2011, Knode applied to the Commission for reinstatement of his
29 surrendered license. Knode had been licensed by the Commission since March 15, 1973, and last
30 held a Standard Administrator License issued March ll, 2003, valid through May l9, 2008, with a
31 Standard Administrator Endorsement.

33 2. Knode voluntarily surrendered his license on November l4, 2005, after subjecting a female
34 educator whom he directly supervised, to sexual advances together with verbal and physical
35 conduct of a sexual nature.

2 3. The Commission denies Knode’s reinstatement application for the following reasons:
3 a. The information Knode submitted, along with his reinstatement documents, do not establish
4 that he possesses good moral character, trustworthiness, or physical and mental health to
5 hold an educator’s license. Pursuant to OAR 584-050-0018(4)(d) (Letters of
6 recommendations from educator colleagues are insufficient alone to establish fitness for
7 licensure following a revocation. The educator must be clear regarding What proactive
8 steps have been taken to ensure t0 the Commission that the conduct that resulted in the
9 revocation is highly unlikely to occur again.)

11 CONCLUSIONS OF LAW

13 The information submitted by Richard Wayne Knode in support of his license renewal failed to
14 establish his fitness to serve as an educator as required by ORS 342.143(2) and OAR 584-050-0018(3).
15 The above described conduct provides the Commission with evidence ofKnode’s lack of fitness to
16 serve as an educator pursuant to OAR 584-050-0006(3)(d) (The Executive Director has evidence that
17 the applicant may lack fitness to serve as an educator).

23 The application for reinstatement of the revoked teaching license of Richard Wayne Knode is
24 DENIED.
