7 On or about May 1, 2009 the Teacher Standards and Practices Commission

8 (Commission) discovered that Robin Ann Manning (Manning) was working on an

9 expired teaching license.
10 After review of the matters alleged, Manning and the Commission agree that their
1 1 respective interests, together with the public interest, are best served by a stipulation to
12 certain facts and the imposition of a Public Reprimand.
1 3 By signing below, Manning acknowledges, understands, stipulates, and agrees to
14 the following: (i) she has been fully advised of her rights to notice and a hearing to
1 5 contest the findings of fact, conclusions of law, and order set forth below, and fully and
16 finally waives all such rights and any rights to appeal or otherwise challenge this
1 7 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this
18 Stipulation and Final Order is a public document and disclosed to the public upon
19 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and
20 subject to approval and adoption by the Commission. If the Commission does not
21 approve and adopt this Stipulation and Final Order, then neither Manning nor the
22 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and
23 Final Order, and understands it completely; (v) she voluntarily, without any force or
24 duress, enters into this Stipulation and Final Order and consents to issuance and entry of
25 the Stipulated Final Order below; (vi) she states that no promise or representation has
26 been made to induce her to sign this Stipulation and Final Order; and (vii) she has
27 consulted with an attorney regarding this Stipulation and Final Order and has been fully
28 advised with regard to her rights thereto, or waives any and all rights to consult with an
29 attorney prior to entering into this Stipulation and Final Order and issuance and entry of

1 STIPULATION OF FACI' S
2 1. The Commission has licensed Manning since May 10, 1996. Manning currently
3 holds a Basic Teaching License, with an endorsement in Basic Advanced
4 Mathematics, issued February 10, 2009 and valid through September 1, 2012.
5 During all relevant times Manning worked for the Rainier School District.
6 2. On October 7, 2007 Manning was issued an Emergency Teaching License to allow
7 her to complete the 2007/2008 school year.
8 3. Manning’s Emergency Teaching License expired on June 30, 2008. The
9 Commission received Manning’s application for renewal on February 6, 2009.
10 4. During the time Manning’s license was expired she taught in a charter school
1 1 within the Rainer School District.
12 5. However, Manning had completed the 24 credit hours necessary for renewal of
13 her Basic Teaching license before expiration of the Emergency Teaching license
14 on June 30, 2008.

24 CONCLUSION OF LAW
25 Robin Ann Manning served without an active license from June 30, 2008, until
26 February 10, 2009. This conduct constitutes Gross Neglect of Duty in violation of OAR
27 584-020-004o(4)(r) (Knowingly working without a license) and OAR 584-020-
28 oo4o(4)(n) as it incorporates OAR 584-020-001o(5) (Use professional judgment), and
29 OAR 584-02o-oo4o(4)(o) as it incorporates OAR 584-020-0035(2)(a) (Apply for,
3O accept, offer, or assign a position of responsibility only on the basis of professional
31 qualifications, and will adhere to the conditions of a contract or the terms of the
32 appointment). The Commissions authority to impose discipline in this matter is based
33 upon ORS 342.175.

2 The Commission hereby imposes a Public Reprimand on the licensure of Robin
3 Ann Manning. /
