7 On or about October 24, 2012, the Teacher Standards and Practices Commission
8 (Commission), received a telephone report indicating Green had been arrested for DUII
9 on September 29, 2012.
1O After review of the matters alleged, Green and the Commission agree that their
1 1 respective interests, together with the public interest, are best served by a stipulation to
12 certain facts and the imposition of a 45 day suspension and a period of probation as
1 3 explained below.
14 By signing below, Green acknowledges, understands, stipulates, and agrees to the
15 following: (i) she has been fully advised of her rights to notice and a hearing to contest
16 the findings of fact, conclusions of law, and order set forth below, and fully and finally
17 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
18 Facts and Final Order of Suspension and Probation (Stipulation and Final Order); (ii)
19 this Stipulation and Final Order is a public document and discltsed to the public upon
20 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and
21 subject to approval and adoption by the Commission. If the Commission does not
22 approve and adopt this Stipulation and Final Order, then neither Green nor the
23 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and
24 Final Order, and understands it completely; (v) she voluntarily, without any force or
25 duress, enters into this Stipulation and Final Order and consents to issuance and entry of
26 the Stipulated Final Order below; (vi) she states that no promise or representation has
27 been made to induce her to sign this Stipulation and Final Order; and (vii) she has
28 consulted with an attorney regarding this Stipulation and Final Order and has been fully
29 advised with regard to her rights thereto, or waives any and all rights to consult with an
30 attorney prior to entering into this Stipulation and Final Order and issuance and entry of
31 the Stipulated Final Order below.

1 STIPULATION OF FACTS

2 1. The Commission has licensed Green since October 25, 1996. Green holds a Basic

3 Teaching License isued July 27, 2012, with an endorsement in Basic Elementary

4 (016), which expires on July 26, 2015. During all relevant times, Green was

5 employed by the Sweet Home School District.

6 2. On November 2, 2012, the Commission adopted the Stipulation of Facts and

7 Final Order of Reprimand and Probation. The Order imposed a Public

8 Reprimand and placed Green on probation for four (4) years subject to

9 conditions. Green agreed as a condition of probation to submit within six months
1O of the adoption of the order, documentation that she had undergone an
1 1 evaluation by a chemical dependency professional acceptable to the Commission.
12 This evaluator was to provide a written evaluation report to the Commission.
13 Green's probation aIso included the requirement that Green shall comply with
14 the Standards for Competent and Ethical Performance of Oregon Educators
15 under Oregon Administrative Rules Chapter 584, Division 020. Green completed
16 an evaluation within six months of the order, but did not timely submit the report
17 to the Commission.
18 3. On October 24, 2012, the Commission received a telephone report from the
19 Sweet Horne Superintendent indicating Green had been arrested for DUII on
20 September 29, 2012. The Commission conducted an investigation as a result of
21 the October 2012 report. According to court records, Green plcd no contest to
22 the DUII charge and entered into a diversion agreement with the courts. Police
23 records indimte Green's blood alcohol level was at .22 percent by volume.

1 CONCLUSIONS OF LAW
2 4. By engaging in the conduct in paragraphs 2 and 3 above, Green engaged in gross
3 neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it
4 incorporates OAR 584-020-0010“) (Use professional judgment); OAR 584-
5 020-0040(4)(k) (Knowing violation 0f any order or rule of the Commission);
6 and OAR 584-020-oo4o(4)(o) as it incorporates OAR 584-020-0035(3)(a)
7 (Maintain the dignity of the profession by respecting and obeying the law,
8 exemplifying personal integrity and honesty). This conduct also constitutes
9 gross unfitness in violation of 0R5 342.175(1)(c); OAR 584-o2o-oo4o(5)(e)
1O (Admission of or engaging in acts constituting criminal mnduct, eve'n in the
1 1 absence of a conviction).
12 5. The Commission's authority to impose discipline in this matter is based upon
13 ORS 342.175.

1 5 ORDER
16 Based on the foregoing, the Commission hereby orders as follows:
17 1. The Commission adopts and incorporates herein the above findings of fact and
18 conclusions of law, and based thereon, suspends Deanna Allaine Green's Basic
19 Teaching License for 45 days from the date this order is signed by the
20 Commission;
21 2. Green is currently on probation as a result of the Stipulation dated November 5,
22 2012, which is set to expire on November 4, 2016, subject to OAR 584-050-0019.
23 Green is hereby placed on probation for an additional year, or November 4, 2017,
24 subject to OAR 584-050-0019:
25 a. Within six (6) months of this order, Green will submit documentation that
26 she has undergone an evaluation by a chemical dependency professional
27 acceptable to the Commission. This evaluator shall provide a written
28 evaluation report to the Comroission. Green shall, at her own initiative and
29 expense, comply with any treatment and/or counseling recommended by the

1 individual who completed the evaluation described above. Green shall
2 authorize and sign any consent forms necessary for the treatment provider 0r
3 counselor to furnish records to or discuss Green's treatment with the
4 Commission.
5 b. Green shall comply with the Standards for Competent and Ethical
6 Performance of Oregon Educators under Oregon Administrative Rules
7 Chapter 584, Division 020.
8 Violation of any term or condition of probation shall constitute an independent basis
9 for the Commission to revoke Green’s teaching license, revoke her right to apply for a
1 0 license, or otherwise impose discipline, after first providing Green with notice and
1 1 opportunity for hearing.
