1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER g JEFFREY KENT LILLEBO ) OF SUSPENSION 7 On or about May 22, 2008, the Teacher Standards and Practices Commission 8 (Commission) received a report indicating that Jeffrey Scott Lillebo (Lillebo), teacher in 9 the Portland Public Schools, made inappropriate comments and engaged in 1O inappropriate behavior towards students at the Metropolitan Learning Center. 1 1 After review of the matters alleged, Lillebo and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition Public Suspension on his teaching license. 14 By signing below, Lillebo acknowledges, understands, stipulates, and agrees to 15 the following: (i) he has been fully advised of his rights to notice and a hearing to 16 contest the findings of fact, conclusions of law, and order set forth below, and fully and 17 finally waives all such rights and any rights to appeal or otherwise challenge this 18 Stipulation of Facts and Order of Suspension (Stipulation and Final Order); (ii) this 19 Stipulation and Final Order is a public document and disclosed to the public upon 20 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 21 subject t0 approval and adoption by the Commission. If the Commission does not 22 approve and adopt this Stipulation and Final Order, then neither Lillebo nor the 23 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 24 Final Order, and understands it completely; (v) he voluntarily, without any force 0r 25 duress, enters into this Stipulation and Final Order and consents to issuance and entry 26 of the Stipulated Final Order below; (vi) he states that n0 promises or representation 27 has been made to induce him to sign this Stipulation and Final Order; and (vii) he has 28 consulted with an attorney regarding this Stipulation and Final Order and has been fully 29 advised with regard to his rights thereto, or waives any and all rights to consult with an 30 attorney prior to entering into this Stipulation and Final Order and issuance and entry 31 0f the Stipulated Final Order below. The Commission has licensed Lillebo as a teacher in Oregon since September 15, 1997. 3 His current Standard Teaching License, with an endorsement in Standard Social Studies 4 was issued on February 12, 2005. 5 2. During a March 10, 2008 forest fieldtrip, Lillebo was in charge of a group of students 6 when the students began a pine-cone-throwing fight, which escalated into students 7 being singled out and using rocks and larger sticks in their fight. Lillebo eventually 8 ended the fight, but later commented to one student that he was proud that he stood up 9 for himself. 10 3. While employed at the Metropolitan Learning Center Lillebo did not follow district 1 1 policy concerning obtaining parental consent when showing films with other than a G 12 rating. Some of the film Lillebo showed had mature content, such as: Dances with 13 Wolves (PG-13), Elizabeth the Golden Age (PG-13), and a History Channel Movie about 14 Army Rangers (unknown rating) which starred a former student of Lillebo’s. 15 4. During the 2007/2008 school year Lillebo put his arm around female student MS’s and 16 rubbed her arms. Lillebo was in the process of taking back his sweatshirt, which he had 17 lent to the student. When she asked Lillebo to stop, he called her a “scaredy cat” and 18 responded, “The little princess doesn’t want me to touch her.” 19 5. During the 2007/ 2008 school year Lillebo commented to his 7th and 8th grade students, 20 “I am not a racist; I hate you all equally,” 0n more than one occasion. Lillebo maintains 21 that his statement was taken from an oft-used quote by a well-known comedian. 22 6. Lillebo commented publically to female student J G-B to ensure that her boyfriend didn’t 23 come to school “stoned.” 24 7. While teaching at Metropolitan Learning Center Lillebo occasionally cursed in the 25 classroom. Lillebo maintains that this occurred when quoting a famous figure or 26 bringing an incident into context. 27 /// 28 /// 29 /// 30 /// 31 /// 32 /// Page 2 STIPULATION OF FACTS ORDER OF SUSPENSION - LILLEBO, JEFFREY KENT 1 8. On August 28, 2003 Lillebo was involved in an incident where he used vulgar language 2 and acted in an intimidating manner in a meeting with a colleague. This incident 3 resulted in a September 15, 2003 written reprimand from the District. 4 / / / 5 IT IS SO STIPULATED: 7 6 / 7 7 MW to’ $110 8 J e rey ent Lillebo Date 9 , . 1o @M a; a - a 1 1 Victoria Ch 1n, Executive Director Date 12 Teacher Standards and Practices Commission 13 / / / 14 CONCLUSION OF LAW 15 Jeffery Kent Lillebo’s conduct and comments toward students as described in 16 paragraphs 2, 4, 5 and 6 above constitutes gross neglect of duty in violation of ORS 17 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(1) (Recognize 18 the worth and dignity of all persons and respect for each individual) and OAR 584-020- 19 0010(5) (Use professional judgment). 20 Mr. Lillebo’s failure to follow district policy in showing films to students as described in 21 paragraph 3 above constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 22 584-020-oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment), 23 and OAR 584-o2o-oo4o(4)(n) as it incorporated OAR 584-020-0025(2)(e) (Using district 24 lawful and reasonable rules and regulations). 25 Mr. Lillebo’s conduct and comments toward students as described in paragraphs 4, 5, 6, 26 and 7 above constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020- 27 oo40(4)(n) as it incorporates OAR 584-020-0010(1) (Recognize the worth and dignity of all 28 persons and respect for each individual) and OAR 584-020-0010(5) (Use professional 29 judgment), and OAR 584-020-0040(4)(0) as it incorporated OAR 584-020-0035(1)(c)(D) 30 (Honoring appropriate adult boundaries with students in conduct and conversations at all 31 times.)
