6 On October 3, 2008, the Teacher Standards and Practices Commission (Commission)

7 received a report from the Superintendent of the Rainier School District that an investigation

8 was conducted regarding allegations that Sharrone Scalf Vincent (Vincent) inappropriately

9 grabbed the arm of a student. After review of the matters alleged, Vincent and the Commission
10 agree that their respective interests, together with the public interest, are best served by a
11 stipulation to certain facts and the imposition of a one year suspension of licensure.
12 This document sets forth the facts upon which the parties have agreed and the stipulated
13 sanction to be imposed. Vincent stipulates that there is sufficient evidence in the Commission's
14 files and records to support the findings of fact, conclusions of law, and order set forth below.
15 By signing below, Vincent acknowledges, understands, stipulates, and agrees to the
16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the
17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
18 such rights and any n'ghts to appeal or otherwise challenge this Stipulation of Facts, Order of
19 Suspension (Stipulation and F inal Order); (ii) this Stipulation and Final Order is a public
20 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
21 Final Order is contingent upon and subject to approval and adoption by the Commission. If the
22 Commission does not approve and adopt this Stipulation and Final Order, then neither Vincent
23 nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation and
24 Final Order, and understands it completely; (v) she voluntarily, without any force or duress,
25 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated
26 Final Order below; (vi) she states that no promises or representation has been made to induce
27 her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney
28 regarding this Stipulation and Final Order and has been fully advised with regard to her rights

1 thereto, or waives any and all rights to consult with an attorney prior to entering into this
2 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This
3 stipulation is contingent upon approval and adoption of the Order by the Commission. If the
4 Commission does not adopt this Order, neither Vincent nor the Commission are bound by these
5 Stipulations and Vincent retains all rights to a hearing on the allegations.
6 STIPULATION 0F FACTS
7 1. The Commission has licensed Sharronne Scalf Vincent since September 9, 1975.
8 Vincent's current Standard Teaching License, issued on June 29, 2008, expires on June
9 28, 2013. During all relevant times Vincent worked as a teacher with Rainier School

1 1 2. During the course of a trial in Columbia County Circuit Court, the Columbia County
12 District Attorney's Office produced evidence that: On September 12, 2008 Vincent
13 confronted two male students as they were leaving her classroom. Another teacher had
14 instructed the students to photocopy their assignments before turning them in for
15 grading. Vincent barred the way of one student, and in an attempt to take his
16 assignment from him, grabbed him by the upper arm leaving visible bruises. As the
17 other student tried to leave Vincent’s classroom, Vincent grabbed him by the arm,
18 leaving a bruise on it.

1 3. At the conclusion of the trial, on September 24, 2009, Vincent was convicted of one

2 count of Harassment (ORS 166.065). Vincent was acquitted of a second count of

3 Harassment. As a result of the conviction Vincent was placed 0n probation for 18

4 months. The terms of that probation specified that Vincent “have no contact with

5 minors where defendant is in an authoritative, teaching, or instructive capacity."

6 Vincent's appeal of the conviction is pending.

13 CONCLUSION OF LAW
14 The Columbia County Circuit Court concluded that Sharrone Scalf Vincent grabbed a
15 student with sufficient force to leave visible bruises. This constitutes gross neglect of duty in
16 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-
17 0010(5) (Use professional judgment) and OAR 584-020-oo1o(1) (Recognize the worth and
18 dignity of all persons and respect for each individual) and OAR 584-020-004o(4)(d)
19 (Unreasonable physical force against students, fellow employees, or visitors to the school,
20 except as permitted under ORS 339.250).
21 As a result of the above described conviction Vincent was convicted of Harassment. As
22 term of Vincent's probation she was not allowed contact with minors in a teaching or
23 authoritative capacity. This constitutes gross neglect of duty in violation of ORS 342.175(1)(b);
24 OAR 584—020-oo40(5)(c) (Conviction ofuiolating any federal, state, or local law. A conviction
25 includes any final judgment of conviction by a court whether as the result of guilty plea, no
26 contest plea or any other means).
27 The Commission has the authority to impose discipline in this matter under ORS
28 342.120 through 342.430 and OAR Chapter 584.

2 The Commission adopts and incorporates herein the above findings of fact and

3 conclusion of law, based thereon, hereby suspends the Standard Teaching License of Sharroune
