10 On May 7, 2010, the Teacher Standards and Practices Commission (Commission)
11 issued a Notice of Opportunity for Hearing to Zuleyma Fernanda Figueroa (Figueroa) in which
12 the Commission charged her with Gross Neglect of Duty pursuant to OAR 584-020-0040(1)(fff).
13 The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7009 1410 0002
14 1902 5153 to the address on file with the Commission. Ms. Figueroa signed for the Certified
15 Mail on May 8, 2010. The Notice of Opportunity of Hearing dated May 7, 2010, and signed by
16 Victoria Chamberlain, Executive Director, stated:
17 “If you want a hearing, you must file a wn'tten request for a hearing with the Commission
18 within 21 days of the date of this notice."

20 Ms. Figueroa did not request a hearing. The Commission, therefore, finds Ms. Figueroa
21 to be in default and enters the following findings of fact, conclusions of law and order, based on
22 the files and records of the Commission concerning this matter.

24 FINDINGS OF FACT
25 On March 5, 2010, in the Circuit Court of the State of Oregon for Multnomah County, Ms.
26 Figueroa pled guilty and was convicted of Unlawful Delivery of Methamphetamine.

28 CONCLUSIONS OF LAW
29 Zuleyma Fernanda Figueroa’s criminal conviction for Unlawful Delivery of
30 Methamphetamine constitutes gross neglect of duty in violation of: OAR 584-020-0040(1)(fff)
31 and ORS 475.890. The Commission's authority to impose discipline in this matter is based upon
32 ORS 342.175.

2 The Commission hereby revokes Zuleyma Fernanda Figueroa’s Initial Administrator and
3 Initial II Teaching licenses and revokes her right to apply for a license.
4 IT IS SO ORDERED THIS 9 day of August, 2010.
