On or about March 10, 2015, the 9 Teacher Standards and Practices Commission (Commission) received a second report from the 10 Pendleton School District alleging that Remington had further violated Professional Standards and 1 1 Practices. 12 After review of the matters alleged, Remington and the Commission agree that their respective 13 interests, together with the public interest, are best served by a stipulation to certain facts, the 14 imposition of a sixty (60) day suspension of his educator license, and a four (4) year period of 1 5 probation. 16 This document sets forth the facts upon which the parties have agreed and the stipulated 1 7 sanction to be imposed. Remington stipulates that there is sufficient evidence in the Commission’s 18 files and records to support the findings of fact, conclusions of law, and order set forth below. 19 By signing below, Remington acknowledges, understands, stipulates, and agrees to the 2O following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 21 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 22 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Suspension and 23 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 24 disclosed to the public upon request by the Commission; (iii) this Stipulation and Final Order is 25 contingent upon and subject to approval and adoption by the Commission. If the Commission does 26 not approve and adopt this Stipulation and Final Order, then neither Remington nor the Commission 27 are bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and understands 28 it completely; (v) he voluntarily, without any force or duress, enters into this Stipulation and Final Page 1 STIPULATION OF FACTS, 60 DAY SUSPENSION- JOHN WILLIAM REMINGTON 1 Order and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no 2 promises or representation has been made to induce him to sign this Stipulation and Final Order; and 3 (vii) he has consulted with an attorney regarding this Stipulation and Final Order and has been fully I 4 advised with regard to his rights thereto, or waives any and all rights to consult with an attorney prior i 5 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order i 6 below. l 7 STIPULATION OF FACTS I 8 1) Remington has been licensed as an Educator in Oregon since April 11, 1990. Remington holds a 9 Standard Teaching License, with endorsements in Basic Drama (02o), and Standard Language 1O Arts (020); valid January 27, 2011, thru January 26, 2016. During all relevant times, Remington 1 1 was employed by the Pendleton School District. 12 2) On April 2, 2014, and March 10, 2015, the Commission received reports alleging Remington 13 displayed inappropriate verbal conduct in the classroom. Subsequent investigation determined 14 that over a period of time Remington: referred to some students as “dicks”; shared inappropriate 15 personal stories indirectly referencing his own past romantic experiences to help explain the 16 literary concept of “epiphany”; during a lesson on symbolism displayed images of a Georgia 17 O'Keefe flower painting and the Nebraska State Capitol Building and suggested that some might 18 see these pieces of art as symbolic representations of female and male genitalia; and relayed a joke 19 from a Seinfeld television episode about “a woman’s body part that rhymed with Delores”. 2° m >// /% 21 ITISS I, :1 A = :1/ _ 22 1 / 1/1"” M 23 F'T'Wwwflg!‘ ’ LL’ _ Date . ,4 . g t / v _, 24 {la/1211i / ’ / 11 ML 25 ictoria Ch t’ lai , Executive Director Date 26 Teacher Standards and Practices Commission 27 CONCLUSIONS 0F LAW 28 John William Remington’s conduct described in section two abovc constitutes gross neglect of 29 duty in violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584-020- Page 2 STlPULATlON OF FACTS, GO DAY SUSPENSION- JOHN WILLIAM REMINGTON 1 0010(1) (Recognize the worth and dignity of all persons and respect for each individual), OAR 584- 2 o2o-001o(5) (Use professional judgment), OAR 584-o2o-oo3o(2)(b) (Skill in communicating with 3 administrators, students, staff, parents, and other patrons); and OAR 584-020-0040(4)(0) as it 4 incorporates, OAR 584-020-0035(1)(c)(D) (Honoring appropriate adult boundaries with students in 5 conduct and conversations at all times). 6 The Commission’s authority to impose discipline in this matter is based upon ORS 342.175. 7 ORDER 8 The Commission hereby adopts and incorporates herein the above stipulation of facts, 9 conclusions of law, and based thereon hereby imposes a sixty (60) day suspension upon Remington’s 10 Educator License as follows: 1 1 John William Remington’s Educator License is hereby suspended for sixty (6o) days following 12 the adoption of this order. 1 3 Furthermore, the Commission imposes a period of four (4) years of probation upon Remington 14 to commence upon reinstatement of his license and subject to the following terms and conditions of 1 5 probation: 16 1.
