g On or about February 20, 2009, the Teacher Standards and Practices

8 Commission (Commission) received a report from the Rogue River School District

9 indicating that Joann Marie Loudermilk (Loudermilk), failed to report two students
10 consuming alcohoi at a school sponsored function.
1 1 After review of the matters alleged, Loudermilk and the Commission agree that
12 their respective interests, together with the public interest, are best served by a
13 stipulation to certain facts and the imposition of a Public Reprimand on Loudermilk’s
14 Standard Teaching License.
15 By signing below, Loudermilk acknowledges, understands, stipulates, and agrees
16 to the following: (i) she has been fully advised of her rights to notice and a hearing to
17 contest the findings of fact, conclusions of law, and order set forth below, and fully and
18 finally waives all such rights and any rights to appeal or otherwise challenge this
19 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this
20 Stipulation and Final Order is a public document and disclosed to the public upon
21 request to the Commission; (iii) this Stipulation and Final Order is contingent upon and
22 subject to approval and adoption by the Commission. If the Commission does not
23 approve and adopt this Stipulation and Final Order, then neither Loudermilk nor the
24 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and
25 Final Order, and understands it completely; (v) she voluntarily, without any force or
26 duress, enters into this Stipulation and Final Order and consents to issuance and entry of
27 the Stipulated Final Order below; (vi) she states that no promise or representation has
28 been made to induce her to sign this Stipulation and Final Order; and (vii) she has

1 consulted with an attorney regarding this Stipulation and Final Order and has been fully
2 advised with regard to her rights thereto, or waives any and all rights to consult with an
3 attorney prior to entering into this Stipulation and Final Order and issuance and entry of
4 the Stipulated Final Order below.
5 ST IPULATION OF FACTS
6 1. The Commission has licensed Loudermilk as a teacher in Oregon since December 3o,
7 1988. Loudermilk’s current Standard Teaching License, with endorsements in Basic
8 Social Studies, and Financial Services, issued on July 21, 2011, is valid until July 20,
9 2016. During all relevant times, Loudermilk was employed by the Rogue River

10 School District.

1 1 2. On January 17, 2009, Loudermilk chaperoned the Winter Formal at Rogue River

12 High School. During this event Loudermilk smelled alcohol on the breath of two

13 students. Loudermilk did not report this incident or address the issue with the

14 students or school security.

24 CONCLUSION OF LAW

25 l Joann Marie Loudermilk’s failure to address student alcohol consumption constitutes

26 gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it

27 incorporates OAR 584-020-oo1o(5) (Use professional judgment), and OAR 584-020-

28 oo25(2)(e) (Using district lawfiil and reasonable rules and regulations).

2 The Commission adopts and incorporates herein the above findings of fact and
3 conclusions of law, and based thereon, imposes a Public Reprimand on Joann Marie
4 Loudermilk’s Standard Teaching License.
