8 On December 14, 2010, the Teacher Standards and Practices Commission (Commission)

9 issued a Notice of Opportunity for Hearing to Gina Rae Bousley (Bousley) in which the
10 Commission charged her with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584-
11 o2o-oo40(4)(o) as it incorporates OAR 584-020-001o(5) and ORS 342.175(1)(b); OAR 584-
12 o20-0040(4)(r). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt
13 7010 0290 0001 6831 4909 to the address on file with the Commission. The Certified mail was
14 returned as unclaimed. The regular mail was not returned and is assumed delivered. The
15 Notice of Opportunity of Hearing, dated December 14, 2010, and signed by Victoria
l6 Chamberlain, Executive Director, stated:
17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD,
18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR
19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL.
20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A
21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY
22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER
23 DISCIPLINE.”

25 Bousley did not request a hearing. The Commission, therefore, finds Bousley to be in default
26 and enters the following findings of fact, conclusions of law and order, based on the files and
27 records of the Commission concerning this matter.
28 FINDINGS OF FACT
29 1. Bousley has been licensed by the Commission since September 14, 2004. Bousley currently
30 hold an Initial I Teaching License, with an endorsement in Language Arts, valid for the
31 middle and high school levels and Multiple Subjects for the middle level, issued September
32 11, 2009 and valid through April 23, 2013.
33 2. On October 6, 2008, the Commission was informed that Bousley was working under an
34 expired license. Bousley allowed her license to expire on April 23, 2008. The Commission
35 did not receive a renewal application until May 22, 2008. The Commission informed

1 Bousley that her application was incomplete. Bousley did not remedy the deficiency in the
2 application packet and worked on her expired license for over a year.
3 CONCLUSIONS 0F LAW
4 Gina Rae Bousley’s conduct as described in #2 above constitutes gross neglect of duty in
5 violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n)as it incorporates OAR 584-020-
6 0010(5) (Use professional judgment); OAR 584-020-0040(4)(r) (Knowingly working without
7 a license)
8 The Commission’s authority to impose discipline in this matter is based upon ORS
9 342.175.
IO FINAL ORDER
11 The Commission hereby imposes a Public Reprimand on Gina Rae Bousley’s Initial I
12 Teaching license.
