LOVOS ) 6 On June 26, 2012, the Teacher Standards and Practices Commission (Commission) 7 charged Gary S. Lovos with Gross Neglect of Duty. Mr. Lovos requested a hearing on July 10, 8 2012. 9 After review of the matters alleged, Mr. Lovos and the Commission agree that their 1 0 respective interests, together with the public interest, are best served by a stipulation to certain 1 1 facts and the revocation of Mr. Lovos’ s Standard Teaching License. 12 This document sets forth the facts upon which the parties have agreed and the stipulated 13 sanction to be imposed. Mr. Lovos stipulates that there is sufficient evidence in the 14 Commission’s files and records to support the findings of fact, conclusions of law, and order set 1 5 forth below. 16 By signing below, Mr. Lovos acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 1 8 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Surrender and Revocation of Licensure (Stipulation and Final Order); (ii) this 21 Stipulation and Final Order is a public document and disclosed to the public upon request by the 22 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval 23 and adoption by the Commission. If the Commission does not approve and adopt this 24 Stipulation and Final Order, then neither Mr. Lovos nor the Commission are bound by the terms 25 herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 26 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and 27 consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REVOCATION — GARY S. LOVOS 1 promises or representation has been made to induce him to sign this Stipulation and Final 2 Order; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order 3 and has been fully advised with regard to his rights thereto, or waives any and all rights to 4 consult with an attorney pn'or to entering into this Stipulation and Final Order and issuance and 5 entry of the Stipulated Final Order below. This Order sets forth the facts upon which the parties 6 have agreed and the sanction to be imposed. Mr. Lovos stipulates that there are sufficient facts 7 contained in the Commission’s files and records to support the findings of fact and conclusions 8 of law set forth below. In entering into this stipulation, Mr. Lovos waives the right to a hearing I 9 to contest the findings of fact, conclusions of law and order set forth below. 1O STIPULATION 0F FACTS 1 1 1. The Commission has licensed Mr. Lovos since July 1, 1978. Mr. Lovos currently holds 12 a Standard Teaching License issued August 27, 2008, with an endorsement in Standard 13 Language Arts and Standard Reading, which expires on August 26, 2013. During all 14 relevant times Mr. Lovos provided substitute-teaching services for various school 1 5 districts. 16 2. On March 31, 2010, Mr. Lovos appeared on duty in the Beaverton School District for a 17 substitute teaching assignment under the influence of alcohol. 18 3. LOVOS 1 CONCLUSION OF LAW 2 Gary Lovos engaged in unprofessional conduct asLovoLovo described in paragraphs 2 3 and 3 above. This conduct constitutes gross neglect of duty in violation of ORS 342.175(1)(b); 4 OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-0010(1) (Recognize the worth and . 5 dignity of all persons and respect for each individual), OAR 584—020-0010(5) (Use 6 professional judgment), OAR 584-020-0020(2)(d) (Skill in the supervision of students), OAR 7 584-020-0030(2)(b) (Skill in communicating with administrators, students, stafl, parents, 8 and other patrons); and OAR 584-020-0040(4)(g) (Appearing on duty or at any district — 9 sponsored activity while under the influence of alcohol or any controlled substance). 1O The conduct in paragraph 3 also constitutes gross unfitness in violation of ORS 342.175(1)(c); 1 1 OAR 584-020-0040(5)(c) (Conviction of violating any federal, state, or local law.
