MEININGER ) 7 0n January 2o, 2016, the Teacher Standards and Practices Commission 8 (Commission) received a report from the Marcola School District, and on March 18, 9 2016, the Commission received an additional report from the Junction City School 1O District. Both districts alleged professional misconduct (teaching on an expired license) 1 1 on the part of licensed educator, Gary Meininger (Meininger). 12 After review of the matters alleged, Meininger and the Commission agree that 13 their respective interests, together with the public interest, are best served by a 14 stipulation to certain facts and the imposition of a public reprimand. 15 By signing below, Meininger acknowledges, understands, stipulates, and agrees 16 to the following: (i) he has been fully advised of his rights to notice and a hearing to 17 contest the findings of fact, conclusions of law, and order set forth below, and fully and 18 finally waives all such rights and any rights to appeal or otherwise challenge this 19 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) 20 this Stipulation and Final Order is a public document and disclosed to the public upon 21 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 22 subject to approval and adoption by the Commission. If the Commission does not 23 approve and adopt this Stipulation and Final Order, then neither Meininger nor the 24 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 25 Final Order, and understands it completely; (v) he voluntarily, without any force or 26 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 27 the Stipulated Final Order below; (vi) he states that no promise 0r representation has 28 been made to induce him to sign this Stipulation and Final Order; and (vii) he has 29 consulted with an attorney regarding this Stipulation and Final Order and has been fully 3O advised with regard to his rights thereto, or waives any and all rights to consult with an 31 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 32 the Stipulated Final Order below, 33 STIPULATION OF FACI‘ S 34 1. Gary Meininger has been licensed by the Commission since August 15, 1979. Meininger’s 35 Substitute Teaching License, with an endorsement in Substitute Any Specialty 36 (PP-12), is valid from May 31, 2016 through July 21, 2019. MEININGER 1 his Substitute Teaching License, Meininger held a Basic Teaching License that 2 was valid from July 22, 2012 through July 21, 2015. During all relevant times, 3 Meininger was employed by the Marcola School District and the Junction City 4 School District providing substitute teaching services. 5 2. The Commission received reports from the Marcola School District and the 6 Junction City School District advising that Meininger had unintentionally 7 neglected to renew his teaching license, resulting in Meininger providing 8 substitute teaching services on several occasions without a valid license. 9 Meininger was unaware that his Basic Teaching License had expired on July 21, 10 2015, so he continued to provide substitute teaching services to both districts. 1 1 Once Meininger was made aware of the situation, Meininger stopped teaching, 12 self-reported the situation, and made application for his Substitute Teaching 13 License. Meininger did not provide any teaching services once he became aware 14 his license had expired. Meininger’s conduct as described above, violates professional standards. 28 Meininger’s conduct constitutes gross neglect 0f duty in violation of ORS 342.175(1)(b); 29 OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-oo1o(5) (Use professional 30 judgment), and OAR 584-020-oo4o(4)(r) (Working without a license). 31 The Commission's authority to impose discipline in this matter is based upon 32 ORS 342.175.
