1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 LLOYD BRUCE WALWORTH ) FINAL ORDER OF REPRIMAND 6 On June 11, 2008, the Teacher Standards and Practices Commission (Commission) 7 received information that Lloyd Bruce Walworth (Walworth) while accompanying students off 8 campus for a musical event, learned that a student became ill, but returned to campus leaving 9 the ill student only in the care of others students. 10 Walworth fully cooperated with the Commission's investigation. After review of the 11 matters alleged, Walworth and the Executive Director agree that their respective interests, 12 together with the public interest, are best sewed by a stipulation to certain facts and a public 13 reprimand. 14 This document sets forth the facts upon which the parties have agreed and the 15 stipulated sanction to be imposed. Walworth stipulates that there is sufficient evidence in the 16 Commissions files and records to support the findings of fact, conclusions of law, and order set 17 forth below. 18 By signing below, Walworth acknowledges, understands, stipulates, and agrees to the 19 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 20 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 21 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 22 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 23 document and disclosed to the public by the Commission upon request; (iii) this Stipulation and 24 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 25 Commission does not approve and adopt this Stipulation and Final Order, then neither Walworth 26 nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 27 Final Order, and understands it completely; (v) he voluntarily, without any force or duress, Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — WALWORTH 1 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 2 Final Order below; (vi) he states that no promises or representations have been made to induce 3 him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney 4 regarding this Stipulation and Final Order and has been fully advised with regard to his rights 5 thereto, or waives any and all rights to consult with an attorney prior to entering into this 6 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 7 STIPULATION OF FACTS 8 1. Lloyd Bruce Walworth currently holds a Standard Teaching License that was issued 9 by the Commission on March 31, 2008. The license is valid through March 30, 2013. 10 2. Walworth is currently employed by The Dalles-Wahtonka High School as a Choir 11 teacher. 12 2. On May 9, 2008 Walworth took a group of students to an event off campus. A female 13 student, whom Walworth knew had a medical condition, suffered a seizure and panic attack 14 during the trip. 15 3. This 28 conduct constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(n) as it Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — WALWORTH 1 incorporates OAR 58¢020-010(5) (Use professional judgment). The Commission has the 2 authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR 3 Chapter 584. 4 FINAL ORDER 5 The Commission hereby adopts and incorporates herein the above findings of fact and 6 conclusion of law and based thereon, here by imposes a Public Reprimand on Lloyd Bruce 7 Walworth.
