. 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND g Educator License of: g FINAL ORDER 0F SUSPENSION g LAURIE ANN GORDON ) 8 In May, 2011, the Commission internally referred Gordon for investigation after 9 learning from the Clackamas Education Service District that Gordon had been working 10 in an Administrative position without a license since October 8, 2007. 1 1 After review of the matters alleged, Gordon and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and a 60 day suspension of Gordon’s teaching license(s) in the State of 14 Oregon. This Stipulation and Final Order resolves all issues in the Commission’s Notice 15 of Opportunity for Hearing dated November 2, 2011; Court of Appeals Case No. A15o754 16 and will serve as the Commission's Final Order in this matter in lieu of an entering a 17 final order on remand from the Court of Appeals. 18 By signing below, Gordon acknowledges, understands, stipulates, and agrees to 19 the following: (i) she has been fully advised of her rights to notice and a hearing to 20 contest the findings of fact, conclusions of law, and order set forth below, and fully and 21 finally waives all such rights and any rights to appeal 0r otherwise challenge this 22 Stipulation of Facts and Final Order of Suspension (Stipulation and Final Order); (ii) this 23 Stipulation and Final Order is a public document and disclosed to the public upon 24 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 25 subject to approval and adoption by the Commission. If the Commission does not 26 approve and adopt this Stipulation and Final Order, then neither Gordon nor the 27 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 28 Final Order, and understands it completely; (v) she voluntarily, without any force or 29 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 3O the Stipulated Final Order below; (vi) she states that no promise or representation has 31 been made to induce him to sign this Stipulation and Final Order; and (vii) she has 32 consulted with an attorney regarding this Stipulation and Final Order and has been fully 33 advised with regard to her rights thereto, or waives any and all lights to consult with an 34 attorney piior to entering into this Stipulation and Final Order and issuance and entry of 35 the Stipulated Final Order below. Page 1 STIPULATION OF FACTS AND 60 DAYSUSPENSION - GORDON, LAURIE 1 STIPULATION OF FACTS 2 1. Gordon has been licensed in Oregon since December 21, 1979. G0rdon‘s current 3 Standard teaching License, with endorsements in Basic Elementary and Standard 4 Speech Impaired, effective on January 16, 2013, will expire January 15, 2018. During 5 all relevant times, Gordon were employed by the Clackamas Education Service 6 District. 7 2. On October 8, 2007, Gordon was hired as a principal for the Long term Care and 8 Treatment Programs in the Clackamas County Education Service District. This 9 position required an Administrator license. Gordon served in this position from 10 October 8, 007 through Mary 12, 2011 without holding an Administrator License. 1 1 3. On November 2, 2011, the Commission entered a Default Order 0f Suspension after 12 Gordon failed to request a hearing on a September 20, 2011 Notice 0f Opportunity 1 3 for Hearing, which alleged that she worked without an Administrator license as 14 described in paragraph 2. 15 4. On December 8, 2011, and December 19, 2011, Gordon requested a stay of the 16 Default Order of Suspension. On January 3, 2012, Gordon made a late hearing 17 request. On February 3, 2012, the Commission denied G0rdon’s late hearing request 18 and request for reconsideration. 19 5. On February 9, 1012 Gordon filed a petition for judicial review of the Commission’s , 20 Default Order of Suspension and Denial of Reconsideration. The Commission 21 withdrew its Final Order on November 2, 2012, then entered an Order 0n 1 22 Reconsideration on November 5, 2012, denying Gordon's request for reconsideration i 23 of the Default Order of Suspension and request for late hearing. Gordon then filed 24 an Amended Petition for Judicial Review 0n December 31, 2012. 25 6. The Court of Appeals issued an opinion on October 1, 2014. The Court vacated and 26 remanded for reconsideration the Commission’s November 5, 2012 Order on 27 Reconsideration, but otherwise affirmed the Commission’s order. 28 /// 29 30 /// 31 32 /// 33 34 /// Page 2 STIPULATION OF FACTS AND 3 MONTH SUSPENSION —- GORDON, LAURIE 1 7. Gordon’s conduct described in paragraph 2 above constitutes Gross Neglect 0f 14 Duty in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it 15 incorporates OAR 584—020-0010(5)(Use professional judgment); OAR 584—020- 16 oo4o(4)(o) as in incorporates OAR 584-020-0035(2)(a)(AppIy for, accept, ofl'er, 17 or assign a position of responsibility only on the basis of professional 18 qualifications, and will adhere to the conditions of a contract or the terms of the 19 appointment); and OAR 584—020-0040(4)(r)(Knowingly working without a 20 license). 21 ORDER 22 1.
