7 This matter came before the Commission on Respondent’s request to reconsider the
l 8 Commission’s Final Order of November 7, 2011 that revoked Respondent’s teaching license.
9 Respondent and the Commission agree to resolve her request by entering into this Sﬁpulated
10 Order of Revocation and License Surrender
ll STIPULATION OF FACTS
12 ll On April 2, 2010 the Commission issued a Notice of Opportunity for Hearing. On
13 November 7, 2011, the Commission entered a ﬁnal order revoking Respondent’s teaching
14 license and revoking Respondent’s right to apply for a teaching license. The Final Order
15 was entered based on Respondent’s November 29, 2009 conviction of one count of Sex
16 Abuse I (ORS 163.427) in Marion County Case No.08C48426.
l7 2v Respondent appealed her conviction. On July 18, 2012, the Court of Appeals reversed
18 her conviction and remanded the case back to the trial court for fturher proceedings.
l9 3i On September 24, 2012, Respondent entered into a plea agreement in Minion County
20 Case No. 12C46632. As part of the plea agreement, the State dismissed one count of Sex
21 Abuse I. Respondent pled no contest to one count of Harassment and the sentence was
22 discharged with no ongoing supervision or tenus of probation. Respondent also agreed to
23 surrender her Oregon teaching license. Respondent’s license expired on October ll,
24 2011, but the Commission retains jurisdiction to take action on the license under ORS
25 342.1750).

2 4. As authorized by ORS 342.1756), on January 24, 2013, Respondent petitioned the
3 Commission to reconsider its November 7, 2011 Final Order and agreed to surrender her
4 teaching license as provided in her ple = :4 eement.

12 Based on the foregoing, the Commission hereby orders as follows:
l3 1. The Commission’s Final Order entered on November 7, 2011 is hereby withdrawn.
l4 2. The Commission accepts the surrender of Respondent’s teaching license that expired on
15 October ll, 2011.
16 3. Respondent’s right to apply for a teaching license is hereby revoked, subject to
17 Respondent’s right to apply for reinstatement under ORS 342.175(4).
