f . 1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACI‘ S AND 4 Educator License of ) FINAL ORDER OF REPRIMAND 5 BARBARA THOMAS LARSON ) AND PROBATION g On or about February 4, 2011, the Teacher Standards and Practices Commission 8 (Commission) received a report from the Pendleton School District, alleging professional 9 misconduct on the part of licensed educator, Barbara Thomas Larson (Larson). 1 O After review of the matters alleged, Larson and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a Public Reprimand and two year Probation. 13 This Order sets forth the facts upon which the parties have agreed and the 14 sanction to be imposed. Larson stipulates that there are sufficient facts contained in the 15 Commission’s files and records to support the findings of fact and conclusions of law set 16 forth below. In entering into this stipulation, Larson waives the right to a hearing to 1 7 contest the findings of fact, conclusions of law and order set forth below. 1 8 By signing below, Larson acknowledges, understands, stipulates, and agrees to 1 9 the following: (i) she has been fully advised of her rights to notice and a hearing to 20 contest the findings of fact, conclusions of law, and order set forth below, and fully and 21 finally waives all such rights and any rights t0 appeal or otherwise challenge this 22 Stipulation of Facts and Final Order of Reprimand and Probation (Stipulation and Final 23 Order); (ii) this Stipulation and Final Order is a public document and disclosed to the 24 public upon request by the Commission; (iii) this Stipulation and Final Order is 25 contingent upon and subject to approval and adoption by the Commission. If the 26 Commission does not approve and adopt this Stipulation and Final Order, then neither 27 Larson nor the Commission are bound by the terms herein; (iv) she has fully read this 28 Stipulation and Final Order, and understands it completely; (v) she voluntarily, without 29 any force or duress, enters into this Stipulation and Final Order and consents to issuance 30 and entry of the Stipulated Final Order below; (vi) she states that no promise or 31 representation has been made to induce her to sign this Stipulation and Final Order; and 32 (vii) she has consulted with an attorney regarding this Stipulation and Final Order and 33 has been fully advised with regard t0 her rights thereto, or waives any and all rights to 34 consult with an attorney prior to entering into this Stipulation and Final Order and 35 issuance and entry of the Stipulated Final Order below. Larson’s Standard 3 Professional Service License, with an endorsement in Standard Counselor (050), 4 was issued on April 27, 2011, and expires on April 26, 2016. During all relevant 5 times, Larson was employed by the Pendleton School District. 6 2. On December 11, 2010, while in Kennewick Washington, Larson was with her 8‘h 7 grade foster daughter and another 8"‘ grade female student. Both children 8 attended school in Larson's school district. Larson got into a dispute regarding a 9 parking space and knowingly scratched (keyed) a car in retaliation. When 10 confronted by law enforcement officers, Larson intentionally denied about her 1 1 involvement with the incident. When the two students were interviewed by 12 police, they detailed Larson's involvement in the incident. Larson was arrested 13 for Malicious Mischief MA 9A.48.o70-09) a felony, and Obstructing a Law 14 Enforcement Officer (WA 9A.76.020). Larson was later convicted of Malicious 15 Mischief 2, a misdemeanor. This conduct 28 constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020- 29 oo4o(4)(n) as it incorporates OAR 584-020-001o(1) (Recognize the worth and dignity 3O of all persons and respect for each individual), OAR 584-020-0010(5) (Use professional 31 judgment), OAR 584-020-oo2o(2)(d) (Skill in the supervision of students); and OAR 32 584-020-oo4o(4)(o) as it incorporates OAR 584-020-0035(3)(a) (Maintain the dignity 33 of the profession by respecting and obeying the law, exemplifying personal integrity 34 and honesty). A conviction includes any final judgment of conviction by a court whether as the 2 result of guilty plea, no contest plea 0r any other means). 3 The Commission’s authority to impose discipline in this matter is based upon 4 ORS 342.175. 5 ORDER 6 Based on the foregoing, the Commission hereby orders as follows: 7 1. The Commission adopts and incorporates herein the above findings of fact and 8 conclusions of law, and based thereon, imposes a Public Reprimand on 9 Barbara Thomas Larson’s Standard Personnel Service License; 1 0 2. Larson is hereby placed on probation for a period of two (2) years from the date 1 1 this order is signed by the Commission subject to the following conditions: 12 a.
