i l 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ 2 OF THE STATE OF OREGON ; 3 In the Matter of the ) STIPULATION OF FACTS i 4 Teaching License of ) AND FINAL ORDER OF 2 GUSTAVE ADOLPH FORSTER ) REPRIMAND 7 On or about June 24, 2009, the Teacher Standards and Practices Commission 8 (Commission) received information related to Gustave Adolph Forster’s (Forster) 9 assignment of educators in violation of licensure rules. 1O After review of the matters alleged, Forster and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a Public Reprimand. 13 By signing below, Forster acknowledges, understands, stipulates, and agrees to 14 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 15 the findings of fact, conclusions of law, and order set forth below, and fully and finally 16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 17 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation 18 and Final Order is a public document and disclosed to the public upon request by the 19 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 20 approval and adoption by the Commission. If the Commission does not approve and 21 adopt this Stipulation and Final Order, then neither Forster nor the Commission are 22 bound by the tenns herein; (iv) he has fully read this Stipulation and Final Order, and 23 understands it completely; (v) he voluntarily, without any force or duress, enters into 24 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 25 Final Order below; (vi) he states that no promise or representation has been made to ' 26 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 27 attorney regarding this Stipulation and Final Order and has been fully advised with 28 regard to his rights thereto, or waives any and all rights to consult with an attorney prior 29 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 3O Final Order below. 31 / / / 32 / / / i 33 / / / Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — FORSTER, GUSTAVE 1 STIPULATION OF FACTS 2 1. The Commission has licensed Forster since July 26, 1985. Forster’s current 3 Standard Administrator License, with Standard Administrator and Standard 4 Superintendent endorsements, issued on August 2, 2009, is valid until August 1, 5 2014. During all relevant times, Forster was employed by the Willamina School 6 District. ' 7 2. Brett Woolley was first licensed as a teacher 0n August 5, 2000. His teaching 8 license expired on June 23, 2008. He submitted an application for an 9 administrator license on May 1, 2009. He currently holds an Initial 10 Administrator License, with an Administrator (all levels) endorsement issued 1 1 August 26, 2009, which expires on June 23, 2013. Mr. Woolley also holds an 12 Initial I Teaching License, issued June 24, 2009, and valid through August 25, 13 2010. From June 23, 2008, through August 26, 2009, Woolley did not have a 14 valid teaching or administrative license from TSPC. 15 3. On September 25, 2008, Forster signed a Professional Educational Experience 16 Report (PEER) Form for Brett Woolley and indicated that Mr. Woolley served as 17 Vice Principal from August 19, 2008, until the present time (February 19, 2009). 18 In a June 10, 2010, letter t0 the Commission, Forster clarified that Mr. Woolley 19\ was not assigned to the role of Vice Principal until September of 2009 and that 20 his contract with the Willamina School District for the 2008-2009 school year 21 states he was a teacher for the district. Woolley did not have a valid teaching 22 license for that time period. 23 4. Forster stated that during the 2008-2009 school year, he assigned Brett Woolley 24 to work as a half-time teacher on special assignment in charge of student 25 discipline matters and as a half-time special education director.
