10 On or about August 14, 2000, the Teacher Standards and Practices Commission received a letter
11 from Springfield Public Schools indicating that the Eugene Police Department searched Neely's
12 home and found pornographic movies and photographs involving nude young girls
13 approximately 13-15 year of age. The Executive Director took action to notify Neely of intent to
14 revoke his license, and to inform him of his opportunity for hearing. The notice was sent via
15 U.S. First Class Mail and U.S. Certified Mail Receipt Z 204 897 149. The certified mail receipt
16 was signed and dated on December 6, 2000. The Notice of Opportunity of Hearing, dated
17 December 4, 2000, and signed by David V. Myton, Executive Director, stated:

19 "You, Carter Webb Neely, are entitled to a hearing on the proposed action of the
20 Commission. Ifyou want a hearing, you must file a written request for a hearing
21 with the Commission within 21 days of the date of this notice. Attached to this
22 notice is a copy of the procedures, right of representation and other rights of
23 parties relating to the conduct of a hearing as required under ORS 183.413(2).

26 FINDINGS OF FACT

28 1. On October 20, 2000, Carter Webb Neely was convicted of Delivery of a Controlled
29 Substance to a Minor (Count 4) in the Circuit Court of the State of Oregon for Lane
30 County.

32 2. On October 20, 2000, Carter Webb Neely was convicted of Delivery of a Controlled
33 Substance to a Minor (Count 5) in the Circuit Court of the State of Oregon for Lane
34 County.

36 3. On October 20, 2000, Carter Webb Neely was convicted of Sodomy in the Third Degree
37 (Count 6) in the Circuit Court of the State of Oregon for Lane County.

40 CONCLUSIONS OF LAW

42 Carter Webb Neely's license is hereby revoked on the grounds that he was convicted of crimes
43 listed in ORS 342.143.
