1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 0F THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER 0F SUSPENSION 5 CHRISTOPHER M. YUCHO ) 6 On or about February 10, 2011, the Teacher Standards and Practices Commission 7 (Commission) received reports indicating that Christopher Michael Yucho (Yucho) may have 8 engaged in conduct constituting gross neglect of duty. 9 The Commission charged Yucho with gross neglect of duty and issued a Notice of 1O Opportunity for Hearing on September 27, 2011. After review of the matters alleged, Yucho and 11 the Commission agree that their respective interests, together with the public interest, are best 12 served by a stipulation to certain facts, the imposition of a suspension of his teaching license, and 1 3 probation. 14 By signing below, Yucho acknowledges, understands, stipulates, and agrees to the 15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings 16 of fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and 17 any rights to appeal or otherwise challenge this Stipulation of Facts, and Order of Suspension 18 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 19 disclosed to the public by the Commission upon request; (iii) this Stipulation and Final Order is 20 contingent upon and subject to approval and adoption by the Commission. lf the Commission 21 does not approve and adopt this Stipulation and Final Order, then neither Yucho nor the 22 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, 23 and understands it completely; (v) he voluntarily, without any force or duress, enters into this 24 Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order 25 below; (vi) he states that no promises or representations have been made to induce him to sign 26 this Stipulation and Final Order; and (vii) he has consulted with an attorney regarding this 27 Stipulation and Final Order and has been fully advised with regard to his rights thereto, or waives Page 1 STIPULATION OF FACTS, ORDER OF SUSPENSIONFYUCHO, CHRISTOPHER MICHAEL 1 any and all rights to consult with an attorney prior to entering into this Stipulation and Final Order 2 and issuance and entry of the Stipulated Final Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Yucho since April 17, 1997. Mr. Yucho currently holds a 5 Standard Teaching License with an endorsement in Standard Elementary, issued November 8, 6 2006, and was set to expire November 7, 2011. He made timely application for renewal of his 7 license, for which his application is pending. During all relevant times, Yucho was employed by the 8 North Clackamas School District. 9 2. On December 17, 2010, Yucho was absent from work. Yucho told his employing school 1O district that he was absent due to his child’s illness, and reported the same on his payroll forms. 11 Investigations determined that Yucho’s child was not sick at this time; instead Yucho left 12 employment early that day to attend an avalanche training related to his role as a mountain search 13 and rescue volunteer. 14 3. When confronted by district administrators about his actions on December 17, 2010, 15 Yucho repeatedly denied being untruthful regarding his absence. Yucho falsified an email from the 16 principal of his child's school by altering the contents of the original email to include inaccurate 17 dates in an attempt to support his denials, and to support his version of events. Yucho continued 18 his denials until confronted with the original email from his child’s schools principal. By engaging in the conduct in paragraph two (2) above, Christopher M. Yucho engaged in 3 gross neglect 0f duty in violation of ORS 342.175(1)(b); OAR 58+020~0040(4)(n) as it incorporates OAR 4 584-020-0010(5) (Use of professional judgment); and OAR 5%020-0040(4)(c) (Knowing falsification of 5 any document or knowing misrepresentation directly related to licensure, employment, or professional 6 duties). 7 2. By engaging in the conduct in paragraph three (3) above, Christopher M. Yucho engaged in 8 gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 9 584-020-0010(5) (Use of professional judgment), OAR 584-020-0025(2)(e) (Using district lawful and 1O reasonable rules and regulations), OAR 584-020-0030(3)(d) (Skill in reconciling conflict); and OAR 584- 1 1 020-0040(4)(c) (Knowing falsification of any document or knowing misrepresentation directly related to 12 Iicensure, employment, or professional duties). . 13 3.
