1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Licensure of ) DEFAULT ORDER OF 5 KAREN ANN BROWN ) DENIAL OF LICENSURE 5 ) 8 On November 12, 2002, the Teacher Standards and Practices Commission issued a 9 Notice of Opportunity for Hearing to Karen Ann Brown, in which the Commission proposed to 10 deny issuance of a license under ORS 342.143(2) and its administrative rules implementing 11 that legal authority OAR 584-050-0006(5). The Notice was sent via U.S. First Class Mail and 12 U.S. Certified Mail Receipt #7001 0320 0005 0740 5499 to the address Ms. Brown provided to 13 the Commission. The certified mail receipt was signed by Ms. Brown and returned to the 14 Commission on November 21, 2002. Karen Ann Brown did not request a hearing. 15 The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive Director, stated: 17 If a request for hearing is not received within this 21-day period, your right to 18 hearing shall be considered waived unless your failure to request a hearing was 19 beyond your reasonable control. If you do not request a hearing or if you fail to 20 appear at a hearing, the Commission will uphold the denial of your application for 21 an Oregon teaching license. g: Based on the foregoing, the Commission finds Karen Ann Brown in default and such 24 default is hereby entered. Based on the records and files of the Commission, the Commission 25 enters the following findings of fact, conclusions of Iaw and order. 26 FINDINGS OF FACT 1 27 1. On January 4, 2001, Ms. Brown signed and submitted an Application for 28 Educator License Form C-1 requesting an Initial Teacher License. Ms. Brown responded “yes” I 29 to character questions and provided a written statement regarding the surrender of her ‘ 30 Nebraska Teaching License in 1999. V 2. Ms. Brown served as a teacher at the Morton School, Adolescent and Family ‘ PAGE 1 - DEFAULT ORDER OF DENIAL OF LICENSURE——-KAREN ANN BROWN ' Services, Linooln Regional Center in Lincoln, Nebraska, from August 20, 1992, until 2 September 30, 1996. In 1996, Ms. Brown was promoted to Principal of Morton School. 3 3. In 1998, while serving as Principal, Ms. Brown became sexually involved with an 4 18 year old former student/inmate of the Morton School who was living in her home. 5 4. On August 31, 1998, Ms. Brown resigned her position at the Morton School and 6 subsequently surrendered her teaching license to Nebraska as a result of her relationship with 7 the former student. 8 CONCLUSIONS OF LAW 9 Sexual conduct with a student OAR 584-020-0040(4)(f) is evidence of lack of fitness to 10 serve as an Oregon educator and a basis for denial of Iicensure pursuant to OAR 584-050- 11 0006(5) and ORS 342.142. 12 ORDER The Commission denies issuance of Iicensure to Karen Ann Brown.
