Dahl (Dahl) in which the Commission 10 charged him with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584-020- 11 0040(4)(n), OAR 584-020-0010(5), OAR 584-020-0040(5)(c), and OAR 584—0202-oo40(5)(e) 12 The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7010 0290 0001 l3 6831 3650 to the address on file with the Commission. Dahl signed for the Certified Mail on 14 June 10, 2011. The Notice of Opportunity of Hearing, dated June 3, 2011, and signed by Victoria 15 Chamberlain, Executive Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, 17 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 18 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 19 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 20 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 21 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 22 DISCIPLINE.” 23 24 Dahl did not request a hearing. The Commission, therefore, finds Dahl to be in default and 25 enters the following findings of fact, conclusions of law and order, based on the files and records 26 of the Commission concerning this matter. 27 FINDINGS OF FACT 28 1. Dahl has been licensed as a teacher in Oregon since October 31, 1980. Dahl’s current Basic 29 Teaching License, with an endorsement in Basic Physical Education, and Basic Social 30 Studies, issued on May 20, 2009, is valid until May 19, 2012. During all relevant times, Dahl 31 was employed by the Lincoln County School District. 32 2. On May 27, 2010, Dahl was stopped for a traffic violation and was in possession of 33 approximately one ounce of marijuana. On June 21, 2010, Dahl pleaded guilty to the 34 violation possession and was fined $500 and had his driver’s license suspended for six 35 months. When interviewed by a Commission investigator, Dahl disclosed continued 36 marijuana use. 37 / / / PAGE 1—DEFAULT ORDER OF REPRIMAND AND PROBATION - DAHL, THOMAS R l CONCLUSIONS OF LAW 2 Thomas R. Dahl’s conduct described in #2 above constitutes gross neglect of duty in 3 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020- 4 0010(5) (Use professional judgment). This conduct also consitutes gross unfitness in violation 5 of ORS 342.175(1)(c); OAR 584-020-0040(5)(c) (Conviction of violating any federal, state, or 6 local law. A conviction includes any final judgment of conviction by a court whether as the 7 result of guilty plea, no contest plea or any other means), and OAR 584-0202-0040(5)(e) 8 (Admission of or engaging in acts constituting criminal conduct, even in the absence of a 9 conviction). 10 The Commission’s authority to impose discipline in this matter is based upon ORS 11 342.175. 12 FINAL ORDER 13 The Commission hereby imposes a Public Reprimand on Thomas R. Dahl’s licensure and 14 includes a four year probation period, from the effective date of this order.
