JACKSON ) AND PROBATION 7 On or about March 31, 2010 the Teacher Standards and Practices Commission 8 (Commission), received a report from a patron of the Three Rivers School District 9 alleging physical and mental abuse of the reporting patron’s son as well as verbal 1O harassment of other students by teacher Robert Jackson. 1 1 After review of the matters alleged, Jackson and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 1 3 certain facts and the imposition of a one year Suspension and four year Probation. 14 By signing below, Jackson acknowledges, understands, stipulates, and agrees to 15 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 16 the findings of fact, conclusions of law, and order set forth below, and fully and finally 17 waives all such rights and any lights to appeal or otherwise challenge this Stipulation of 18 Facts and Final Order of Reprimand and Probation (Stipulation and Final Order); (ii) 1 9 this Stipulation and Final Order is a public document and disclosed to the public upon 2O request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 21 subject to approval and adoption by the Commission. The Commission has licensed Jackson since July 18, 2002. J ackson’s current 3 Initial I Teaching License, with an endorsement in Physical Education (ML/ HS), 4 issued on October 19, 2009, is valid until July 18, 2012. During all relevant 5 times, Jackson was employed by the Three Rivers School District. 6 2. On 0r about March of 2009, Jackson engaged in separate telephone 7 conversations with both a patron and the patron’s son regarding a difference of 8 opinion. The difference of opinion was regarding the patron’s son's basketball 9 playing time (lack of) and patron’s son not making the State basketball team. 1 0 District and Commission investigations indicated that Jackson and patron both 1 1 created conflict, used disparaging remarks, and were generally hostile during the 12 conversations. During J ackson’s conversation with the patron’s son, Jackson told 13 the student that his father was an “asshole”. J ackson’s conduct with the patron 14 and patron’s son was unprofessional. 15 3. On January 29, 2009 and June 14, 2005, Jackson was disciplined for “poor 16 communication” by letter of expectation at the school district level. Jackson has been counseled regarding 32 similar behaviors in the past. This conduct constitutes gross neglect of duty in violation 33 of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020- 34 0010(5) (Use of professional judgment), OAR 584-020-oo1o(1) (Recognize the worth Page 2 STIPULATION OF FACTS AND ORDER OPSUSEENSJQQ AND PROBATION —- JACKSON, ROben Kfprl'rnarwl n’ 1 and dignity of all persons and respect for each individual), OAR 584-020-0030(2)(a) 2 (Willingness t0 be flexible in cooperatively working with others), OAR 584-020- 3 0030(2)(b) (Skill in communicating with administrators, students, stafl, parents, and 4 other patrons), and OAR 584-020-003o(3)(d) (Skill in reconciling conflict). 5 The Commission’s authority to impose discipline in this matter is based upon 6 ORS 342.175. 7 ORDER 8 Based 0n the foregoing, the Commission hereby orders as follows: 9 1. The Commission adopts and incorporates herein the above findings of fact and 10 conclusions of law, and based thereon, imposes a Public Reprimand on 1 1 Robert J. J ackson’s Initial I Teaching License; 12 2. Jackson is hereby placed on probation for a period of four (4) years from the date 13 this order is signed by the Commission subject to the following conditions: 14 a. Jackson will submit to TSPC a letter 0f continuing compliance from the 1 5 district administration on an annual basis beginning one year from the 16 date 0f this order. The letters 0f continuing compliance must be submitted 17 in writing and received by TSPC within 14 calendar days of due dates 1 8 listed below: 19 I Letters to be received on, or before, February 6, 2012, February 6, 20 2013, February 6, 2014 and February 6, 2015. 21 b.
