WSTIimleTHONOFFACTSZNg .......... . . . . .. 4 Teaching License of ) FINAL ORDER OF SUSPENSION 5 CORY ARWOOD SAN DVOLD ) AND PROBATION 6 On or about May 9, 2011, the Teacher Standards and Practices Commission 7 (Commission) received information relating to Cory Arwood Sandvold (Sandvold). 8 After review of the matters alleged, Sandvold and the Commission agree that their 9 respective interests, together with the public interest, are best served by a stipulation to certain 1 O facts, the imposition of a six (6) month suspension of Sandvold’s Oregon Teaching License 1 1 . followed by a four (4) year probation and monitoring period. 12 This document sets forth the facts upon which the parties have agreed and the stipulated 1 3 sanction to be imposed. Sandvold stipulates that there is sufficient evidence in the 14 Commission’s files and records to support the findings of fact, conclusions of law, and order set 1 5 forth below. ' 16 By signing below, Sandvold acknowledges, understands, stipulates, and agrees to the 1 7 following: (i) he has been fully advised of his rights to notice and a hearing to contest the ‘ 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all , 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final - 20 Order of Suspension and Probation (Stipulation and Final Order); (ii) this Stipulation and Final 21 Order is a public document and disclosed to the public upon request by the Commission; (iii) ~- 22 this Stipulation and Final Order is contingent upon and subject to approval and adoption by the 23 Commission. This ; 5 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. 6 Sandvold stipulates that there are sufficient facts contained in the Commission’s files and 7 records to support the findings of fact and conclusions of law set forth below. In entering into 8 this stipulation, Sandvold waives the right to a hearing t0 contest the findings of fact, ' 9 conclusions of law and order set forth below. 1O STIPULATION OF FACTS 1 1 1. The Commission has licensed Cory Sandvold since November 8, 2006. Sandvold 12 currently holds an Initial ITeaching License issued November 20, 2007, that is valid I 13 through October 14, 2011; with an endorsement in Physical Education. On October 11, 14 2011, Sandvold made timely application for renewal and his expiration date was 15 extended. During all relevant times, Sandvold was employed by the Hillsboro School 1 6 District. ' 17 2. On April 20, 2011, Sandvold, while playing one-on-one soccer with students in his 1 8 physical education class, repeatedly taunted and physically pushed a student. Sandvold 19 then yelled, “Get out!” to the class. Some students exiting Sandvold’s class were crying 20 and later expressed fear in returning to Sandvold’s class in the future. School District 21 Oflicials recommended Sandvold for dismissal for related policy violations: 22 GBNA/JFCF-AR: Hazing / Harassment / Intimidation/ Bullying / Menacing; GCAA- 23 Standards for Competent and Ethical Performance of Oregon Educators; J GA: Corporal 24 Punishment. Sandvold’s conduct was witnessed by other 1 O students and a teacher. Sandvold's behavior created a hostile educational environment that 1 1 intimidated students and placed them in fear. This conduct constitutes gross neglect of duty in 12 violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584-020- 13 0010(1) (Recognize the worth and dignity of all persons and respect for each individual), OAR 14 584-020-0010(5) (Use professional judgment), OAR 584~oao—oozo(2] (d) (Skill in the 15 supervision of students), OAR 584-020-0025(2)(a) (Establishing and maintaining classroom 16 management that is conductive to learning), OAR 584—020-0025(2)(e) (Using district lawfiil 17 and reasonable rules and regulations), OAR 584-020-0030(2)(b) (Skill in communicating with 18 administrators, students, stafi; parents, and other patrons); OAR 584-020-0030(3)(d) (Skill in 19 reconciling conflict); OAR 584-020-oo4o(4)(o) as it incorporates OAR 584-020- 20 oo35(1)(c)(D)(Honoring appropriate adult boundaries with students in conduct and 21 conversations at all times.) ; 584-020-004o(4)(d) (Unreasonable physical force against 22 snidents, fellow employees, or visitors to the school, except as permitted under ORS 339.250), ' 23 and OAR 584-020-oo4o(4)(e) (Violent or destructive behavior on school premises or at a 24 school-sponsored activity). 25 The Commission’s authority to impose discipline in this matter is based upon ORS 26 342.175. 27 ORDER 28 The Commission hereby adopts and incorporates herein the above stipulation of facts, 29 conclusions of law, and based thereon hereby imposes a six (6) month suspension upon 3O Sandvold’s Initial I Teaching license as follows: Page 3 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - SANDVOLD, CORY 1 Cory Arwood Sandvold’s Initial I Teaching License is hereby suspended for six (6) f 2 months following the adoption of this order.
