1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 1 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) IMPOSITION OF 6 JEREMY DEAN CAMPBELL ) PUBLIC REPRIMAND 7 8 On March 26, 2009, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Jeremy Dean Campbell (Campbell) in which the 10 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7008 1140 0002 8580 9140 to the address on 12 file with the Commission. The Notice of Opportunity of Hearing, dated March 26, 2009, and 13 signed by Victoria Chamberlain, Executive Director, stated: 14 "You, Jeremy Dean Campbell, are entitled to a hearing on the proposed action of 15 the Commission. If you want a hearing, you must file a written request for a 16 hearing with the Commission within 21 days of the date of this notice. Attached 17 to this notice is a copy of the procedures, right of representation and other rights 18 of parties relating to the conduct of a hearing as required under ORS 19 183.413(2)." 20 21 The certified mail receipt shows that Campbell received the notice on March 27, 22 2009, but he did not request a hearing until April 23, 2009, after the period of 21 days in 23 which to request a hearing had expired. Unaware of the late hearing request, the 24 Commission found Campbell to be in default and entered into a Default Order of 25 Imposition of Public Reprimand on May 4, 2009. 26 Campbell was asked to provide an explanation as to why his request for a 27 > hearing was late. An Order Withdrawing Default Order to Consider Late Hearing 28 Request was adopted on July 22, 2009. On August 7, 2009, the Commission 29 considered and denied Campbell's late hearing request because his failure to make a 30 timely request for a hearing was not due to circumstances beyond his reasonable 31 control. CAMPBELL ‘ 1 following findings of fact, conclusions of law and order, based on the files and records of 2 the Commission concerning this matter. 3 c FINDINGS OF FACT 4 1. On or about February 27, 2008, the Commission received information that Campbell was 5 convicted of Theft ll in Marion County Circuit Court in 1992. Campbell failed to disclose this 6 conviction on prior C-1 applications submitted to the Commission dated October 14, 2001, 7 September 5, 2002, and August 3, 2005. 8 2. On or about June 30, 2008, Campbell plead guilty to, and was convicted of, one count of 9 Assault IV. This conviction stemmed from Campbell assaulting his step-son who was 6 10 years of age at the time. The assault resulted in scratching or bruising to Campbell's step— 11 son's neck. 12 CONCLUSIONS 0F LAW L31 Jeremy Campbell's failure to disclose his August 4, 1992, conviction of Theft II on each 15 C-1 application constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584- 16 020-0040(4)(c) (Knowing falsification of any document or knowing misrepresentation directly 17 related to Iicensure, employment, or professional duties). Campbell's conviction for Assault IV 18 constitutes gross neglect of duty in violation of ORS 342.175(1)(b) and gross unfitness in 19 violation of ORS 342.175(1)(c); OAR 584-020-0040(5)(c) (Conviction of a crime).
