1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON , 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND FINAL ORDER 5 ALASON EILEEN HILL ) OF REPRIMAND 6 On September 28, 2006, the Teacher Standards and Practices Commission 7 (Commission) received a report from Jeremy Lyon, Superintendent, Hiilsboro School District 8 indicating Hill was placed on administrative leave for two days as the District investigated the 9 possibility of an inappropriate relationship with a male student. 10 After review of the matters alleged, Ms. Hill and the Commission agree that their ‘ 11 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Ms. Hill stipulates that there is sufficient evidence in the 15 Commission's files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Ms. Hill acknowledges, understands, stipulates, and agrees to the 18 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 19 findings of fact, conclusions of Iaw, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public I 22 document and disclosed to the public by the Commission upon request; (iii) this Stipulation and 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. Hill 25 nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 26 Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 27 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 28 Final Order below; (vi) she states that no promises or representations have been made to Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - HILL 1 induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 2 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 3 thereto, or waives any and all rights to consult with an attorney prior to entering into this 4 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 5 STIPULATION OF FACTS 6 1. Ms. Hill has been licensed by the Commission since June 28, 2002. Ms. Hill currently 7 holds an Initial l Teaching License issued January 15, 2008 with endorsements in Health 8 Education, Multiple Subjects, and Physical Education. Said license expires January 14, 2011. 9 2. During the 2004-2005 school year, while teaching at Thomas Middle School, Hill 10 began a close relationship she characterized as mentoring, with a male student and his family. 11 That relationship continued following the student's graduation from the middle school and 12 included a trip out of state with the student, his sibling and HilI‘s children with the student's 13 parents‘ permission. 14 3. On May 26, 2006 Hill's principal gave her a written directive not to have contact with 15 the student outside of school. This directive cautioned against engaging in behaviors that can 16 be misconstrued, such as remaining alone with a student in the classroom, making a habit of 17 meeting a student outside of school, counseling a student in nonacademic matters and 18 transporting a student in one's personal vehicle. 1 9 / / l 20 / l / 21 / l/ 22 ll / 23 /// 24 l/l 25 / / / 26 /// 27 / l I Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - HILL 1 4. Hill continued her close relationship with the student's family. In the course of 2 providing assistance to the family, the student translated for Hill and the students mother. The 3 District concluded that Hill's actions violated the administrative directive. On September 26, 4 2006 Hill was given a letter of reprimand for failing to adhere to the previous directive regarding 5 contact with the student. 6 ITl OSTIPUL El A I . She failed to 14 completely break ties with the students family after being directed by her superiors to 15 have no contact with the student. This misconduct constitutes Gross Neglect of Duty, 16 pursuant to OAR 584»020-OO40(4)(n) as it incorporates OAR 584»020-0035(c)(A). The 17 Commission has the authority to impose discipline in this matter under ORS 342.120 18 through 342.430 and OAR Chapter 584. 19 ORDER 20 The Commission hereby adopts and incorporates herein the above findings of , 21 fact, conclusions of law and imposes a Public Reprimand upon the Iicensure of Alason 22 Eileen Hill.
