JUN - 8-2015 ' 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION’ , , 2 OF THE STATE OF OREGON ' I i ’ 1' u 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Educator License of ) FINAL ORDER OF 5 LESLEY ANNE MEANEY ) SURRENDER OF LICENSE AND RIGHT 6 ) TO APPLY g On or about June 20, 2012, the Teacher Standards and Practices Commission 9 (Commission) received a complaint from the Gresham Police Department, indicating that 10 licensed educator, Lesley Meaney (Meaney), had committed acts of unprofessional conduct. 1 1 After review of the matters alleged, Meaney and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts, Meaney’s surrender of her Oregon educator license and of her right to apply for an Oregon 14 license. 15 By signing below, Meaney acknowledges, understands, stipulates, and agrees to the 16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the ~ 17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all > , 18 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 19 Order of Educator’s Surrender of License and Right to Apply (Stipulation and Final Order); (ii) 20 this Stipulation and Final Order is a public document and disclosed to the public upon request 21 by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 22 approval and adoption by the Commission. If the Commission does not approve and adopt this 23 Stipulation and Final Order, then neither Meaney nor the Commission are bound by the terms 24 herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely; 25 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and 26 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no 27 promises or representation has been made to induce her to sign this Stipulation and Final 28 Order; and (vii) she has consulted with an attorney regarding this Stipulation and Final Order Page 1 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER OF LICENSE AND RIGHT TO APPLY- LESLEY ANNE MEANEY 1 and has been fully advised with regard to her rights thereto, or waives any and all rights to 2 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and 3 entry of the Stipulated Final Order below. 4 This Order sets forth the facts upon which the parties have agreed and the sanction to be 5 imposed. Meaney stipulates that there are sufficient facts contained in the Commission’s files 6 and records to support the findings of fact and conclusions of law set forth below. In entering 7 into this stipulation, Meaney waives the right to a hearing to contest the findings of fact, 8 conclusions of law and order set forth below. 9 STIPULATION OF FACT S 10 1. The Commission has licensed Meaney since June 29, 2004. Meaney currently holds a 1 1 Continuing Teaching License, with endorsements in Multiple Subjects (MIDLVL), 12 Multiple Subjects Self-Contained(ECE, ELE), Health Education (ML, HS), and Physical I 13 I I Education (HS, ML), valid October 11, 2011, through January 16, 2017. During all I i 14 I I relevant times, Meaney was employed by the Centennial School District. , I I I I 15 I 2. : On June 20, 2012, the Commission received a complaint of possible misconduct on the '. 1 16 part of Meaney, from the Gresham Police Department. The complaint alleges that 17 Meaney had reason to know that an inappropriate relationship existed between a 18 teaching assistant (Dial) and a high school student (DM) on or around 2008-2009 based 19 on observations she made and had failed to report the misconduct. Commission 20 investigation determined that Meaney made the following observations over 2008 — 21 2009: 22 a. During a “movie night” at Dial’s residence, attended by several cheerleaders, for 23 whom Meaney served as coach, and some football players, Meaney observed 24 Dial, the mother of a cheerleader, seated on a couch with multiple students. Dial 25 and student DM were sharing a blanket. Page 2 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER OF LICENSE AND RIGHT TO APPLY- LESLEY ANNE MEANEY ii 1 b. During the summer of 2008, while at Dia1’s residence, Meaney observed student 2 DM place his arm around Dial in the presence of others. Dial’s son observed this 3 and physically removed DM’s arm from around his mother. 4 c. During the same visit, Meaney observed Dial bend over to pick something up 5 from the ground, and Dial shook her buttocks in the presence of student DM and 6 others. 7 d. When seeking Dial to say goodbye, Meaney found Dial and student DM, talking 8 alone in the basement of Dial’s residence. One was standing, and one was sitting, 9 and Meaney observed no physical contact between them. 1O e. Meaney is legally blind and her visual acuity, i.e. the sharpness of images she 1 1 sees, is severely impaired. 12 f. Though Meany did observe the actions described, she did not form the conclusion 13 at the time that there was a relationship that required reporting. 14 g. Meaney was never criminally charged for failing to report about that relationship, 15 - -:for failing to report any other suspected abuse, or for any other matter. 16 h.
