CHESLA ) AND PROBATION g 8 On or about August 22, 2007, the Teacher Standards and Practices Commission 9 (Commission) received a report indicating that Patty W. Chesla, teacher for Oregon Trail School 10 District, may have engaged in conduct constituting gross neglect of duty. 11 After review of the matters alleged, Ms. Chesla and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts, the imposition of a public reprimand, and probation. 14 By signing below, Ms. Chesla acknowledges, understands, stipulates, and agrees to the 15 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 16 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 17 such rights and any rights to appeal or othenm'se challenge this Stipulation of Facts and Order 18 of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is 19 a public document and disclosed to the public upon request by the Commission; (iii) this 2O Stipulation and Final Order is contingent upon and subject to approval and adoption by the 21 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 22 then neither Ms. Chesla nor the Commission are bound by the terms herein; (iv) she has fully 23 read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, without 24 any force or duress, enters into this Stipulation and Final Order and consents to issuance and 25 entry of the Stipulated Final Order below; (vi) she states that no promises or representation has 26 been made to induce her to sign this Stipulation and Final Order, and (vii) she has consulted 27 with an attorney regarding this Stipulation and Final Order and has been fully advised with 28 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to Page 1 STIPULATION OF FACTS ORDER; 0F SUSPENSION - CHESLA 1 entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final 2 Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Ms. Chesla since April 2005. Chesla currently holds a 5 Substitute Teaching License. This license was issued September 27, 2009 and is valid 6 through September 26, 2011. 7 2. During the 2006-2007 school year, while working for the Oregon Trail School District, 8 Ms. Chesla resided with her husband, Kevin Chesla. At their residential property, her 9 husband grew and used marijuana with her knowledge. During this time they had a 10 daughter who was 18 months old living with them. On or about December 3, 2007, her 11 husband was convicted of Manufacture of Marijuana, ORS 475.856, a Class A Felony. 12 3. Ms. Chesla allowed her young daughter to live in a place where drugs were 13 manufactured or used. 14 lT IS SO STIPULATED: :2 10/ ZZ Z Ofl 17 Patty W esla Date 13 MM) flaw-fir 20 Victoria C , Executive Director Date 21 Teacher Standards and Practices Commission 22 CONCLUSION OF LAW 23 Ms. Chesla‘s knowing acquiescence of criminal activity while parent to a young child, as 24 described in paragraph 2 above, constitutes gross neglect of duty in violation of ORS 25 342.175(1)(b); OAR 584-020-0040(4)(o) (Substantial deviation from professional standards of 26 ethics) as it incorporates OAR 584-020-0035(3)(a) (Maintain the dignity of the profession by 27 respecting and obeying the law, exemplifying personal integrity and honesty). 28 l l l 29 l/ / Page 2 STIPULATION OF FACTS ORDER OF SUSPENSION - CHESLA 1 Ms. Chesla allowing her young daughter to live in a place where drugs were 2 manufactured or used, as described in paragraph 3 above, constitutes gross unfitness in 3 violation of ORS 342.175 (1)(c); OAR 584-020-0040(5)(e) (Admission of or engaging in acts 4 constituting criminal conduct, even in the absence of a conviction) specifically ORS 5 163.575(1)(b), Endangering the Welfare of a Minor (Permits a person under eighteen years of 6 age to enter or remain in a place where unlawful activity involving controlled substances is 7 maintained or conducted). 8 ORDER 9 The Commission adopts and incorporates herein the above findings of fact and 10 conclusions of law and, based thereon, imposes a Public Reprimand on Patty W. Chesla. 11 1. This Order shall serve as the Public Reprimand. 12 2. Furthermore, the Commission places Ms. Chesla on Probation for a period of three 13 (3) years probation subject to the following terms and conditions: 14 a. Ms. Chesla shall report in writing within ten days to the Executive Director of the 15 Commission any arrest or citation for any felony, misdemeanor, major traffic 16 violation or violation of criminal probation; and 17 b.
