1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of: ) AND _ 5 JENNIFER A. ROGAN ) FINAL ORDER OF REPRIMAND 6 On June 3, 2009, the Teacher Standards and Practices Commission (Commission) 7 issued a Notice of Opportunity for Hearing to Ms. Rogan on allegations of Gross Neglect of 8 Duty. Ms. Rogan requested a hearing. 9 After review of the matters alleged, Ms. Rogan and the Commission agree that their 1O respective interests, together with the public interest, are best served by a stipulation to certain 11 facts and the imposition of a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Ms. Rogan stipulates that there is sufficient evidence in the 14 Commission's files and records to support the findings of fact, conclusions of law, and order set 15 forth below. 16 By signing below, Ms. Rogan acknowledges, understands, stipulates, and agrees to the 17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 21 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 24 Rogan nor the Commission are bound by the terms herein; (iv) she has fully read this 25 Stipulation and Final Order, and understands it completely; (v) she voluntarily, without any force 26 or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the 27 Stipulated Final Order below; (vi) she states that no promises or representation has been made Page 1 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - ROGAN 1 to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an 2 attorney regarding this Stipulation and Final Order and has been fully advised with regard to her 3 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 4 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 5 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. 6 Ms. Rogan stipulates that there are sufficient facts contained in the Commission's files and 7 records to support the findings of fact and conclusions of law set forth below. ln entering into 8 this stipulation, Ms. Rogan waives the right to a hearing to contest the findings of fact, 9 conclusions of law and order set forth below. 1O STIPULATION OF FACTS 11 1. Ms Rogan was employed as a temporary math teacher at daVinci Arts Middle School 12 in the Portland Public School District from February 19, 2008 through June, 2008. Ms. Rogan 13 holds an Initial 1 Teaching License, effective July 31, 2007 through October 5, 2010. 14 2. In May of 2008, Ms. Rogan gave a 14 year old female student a gift consisting of a 15 pair of slippers she made out of unused feminine hygiene pads. 16 3. In May of 2008, Ms. Rogan gave a 12 year old male student a birthday card that 17 featured a two inch sponge female doll that increased in size when placed in water. Rogan gave an inappropriate gift to student AM-G and gave an inappropriate I 3 card to MW, as described in paragraphs 2 and 3 above. This conduct constitutes Gross Neglect 4 of Duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(o) as it incorporates 5 OAR 584-020-0035(1)(c)(D)(honoring appropriate adult boundaries with students in conduct 6 and conversations at all time). The Commission has the authority to impose discipline in this 7 matter under ORS 342.120 through 342.430 and OAR Chapter 584. 8 FINAL ORDER 9 The Commission adopts and incorporates herein the above finding of facts, 1O conclusions of law, and based thereon, imposes a Public Reprimand on Jennifer A.
