1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 STATE OF OREGON 3 In the Matter of the Teaching License 0f: ) STIPULATION OF FACTS 4 EDWIN CAM PROPST g FINAL OaRllgER OF REPRIMAND 5 ____—___) 6 On April 30, 2009, the Teacher Standards and Practices Commission (Commission) referred 7 Mr. Propst for investigation regarding teaching without a license. 8 After review of the matters alleged, Mr. Propst and the Commission agree that their respective 9 interests, together with the public interest, are best served by a stipulation to certain facts and a public 10 reprimand. ll This document sets forth the facts upon which the parties have agreed and the stipulated 12 sanction to be imposed. Mr. Propst stipulates that there is sufficient evidence in the Commission’s l3 files and records to support the findings of fact, conclusions of law, and order set forth below. 14 By signing below, Mr. Propst acknowledges, understands, stipulates, and agrees to the 15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of l6 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 17 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand I l8 (Stipulation and Final Order), (ii) this Stipulation and Final Order is a public document and disclosed l9 to the public upon request by the Commission, (iii) this Stipulation and Final Order is contingent upon 20 and subject to approval and adoption by the Commission. If the Commission does not approve and 21 adopt this Stipulation and Final Order, then neither Mr. Propst nor the Commission are bound by the 22 terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 23 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to 24 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or 25 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he has 26 PAGE 1 - STIPULATION OF FACTS and FINAL ORDER OF REPRIMAND (EDWIN C. PROPST) 4 \ 1 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with 2 regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering 3 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 4 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Mr. 5 Propst stipulates that there are sufficient facts contained in the Commission‘s files and records to 6 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, 7 Mr. Propst waives the right to a hearing to contest the findings of fact, conclusions of law and order set 8 forth below. 9 STIPULATION OF FACTS 10 1. Mr. Propst has been licensed as a teacher in Oregon since December 7, 2004. His current 11 Initial I Teaching License, with an endorsements in Music (HS/ ML), was issued on August 24, 12 2006, and is pending renewal. During all relevant times, Mr. Propst was employed by the l3 Central School District. l4 2. On August 16, 2006, Mr. Propst submitted an application for an Initial I Teaching License. On 15 August 30, 2006, the Commission notified him at the address on file with the Commission, by 16 certified and regular mail, that his check #473 was returned for uncollected funds. Mr. Propst l7 received this notice on September 6, 2006, as indicated by his signature on the certified mail 18 return receipt # 7005 1160 0001 0494 7494. 19 3. The Commission did not receive a response from Mr. Propst nor did the Commission receive 20 the required fee. . 21 4. On July 28, 2007, Mr. Propst contacted the Commission to update his address. An email reply 22 was sent to him on July 28, 2007, notifying him of the original notice regarding the returned 23 check. On April 27, 2009, Mr. Propst contacted the Commission and indicated that he was completing 2 his third year of teaching and sought information regarding renewal of his license. The TSPC 3 staff notified Propst and his employer that he still owed payment from 2006.
