1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE SUSPENSION 6 AMANDA SUSAN MCMAHAN-ORENDORFF ) 7 8 On April 7, 2011, the Teacher Standards and Practices Commission (Commission) issued 9 a Notice 0f Opportunity for Hearing to Amanda Susan McMahan-Orendorff (McMahan- 10 Orendorff) in which the Commission charged her with Gross Neglect of Duty and Gross 11 Unfitness pursuant to OAR 584-020-0040(4)(n), OAR 584-020-oo1o(5), OAR 584-020- 12 oo4o(4)(o), OAR 584-020-0035(3)(a), OAR 584-020-004o(4)(c)and OAR 584-020- 13 0040(5)(c). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7010 14 0290 0001 6831 3896 to the address on file with the Commission. Neither the Certified Mail 15 nor the regular mail were not returned to the Commission, and are assumed delivered. The 16 Notice of Opportunity of Hearing, dated April 7, 2011, and signed by Victoria Chamberlain, 17 Executive Director, stated: 18 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, 19 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 20 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 21 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 22 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 23 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 24 DISCIPLINE.” 25 26 McMahan-Orendorff did not request a hearing. The Commission, therefore, finds McMahan- 27 Orendorff to be in default and enters the following findings of fact, conclusions of law and order, 28 based on the files and records of the Commission concerning this matter. 29 FINDINGS OF FACT 3O 1. McMahan-Orendorff has been licensed as a teacher in Oregon since September 11, 2007. 31 Her Initial I Teaching License, with endorsements in Language Arts (HS, ML), Multiple 32 Subjects (MIDLVL), and Social Studies (HS, ML), issued on September 11, 2007, expired 33 on December 16, 2010. McMahan-Orendorff timely applied for renewal. During all 34 relevant times, she was employed by the Portland Public School District. 35 PAGE 1-DEFAULT ORDER OF LICENSE SUSPENSION — MCMAHAN-ORENDORFF, AMANDA SUSAN 1 2. On May 20, 2010, McMahan-Orendorff was convicted of Theft in the First Degree (ORS 2 164.055) a Class C Felony. This conviction arose from McMahan-Orendorffs theft of 3 approximately $6,459 from the Portland Rescue Mission’s Children Center. 4 3. During a December 20, 2010, interview with a Commission investigator, McMahan- 5 Orendorff said that she took responsibility for the theft but denied personally stealing 6 the money. On February 5, 2010, McMahan-Orendorff signed a statement admitting to 7 Portland Rescue Mission staff that she stole approximately $6,459. 8 CONCLUSIONS OF LAW 9 Christine A. McMahan-Orendorff conduct described in #2 above constitutes gross 10 neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates 11 OAR 584-020-0010(5) (Use professional judgment); OAR 584-020-oo4o(4)(o) as it 12 incorporates OAR 584-020-0035(3)(a) (Maintain the dignity 0f the profession by respecting 13 the and obeying the law, exemplifying personal integrity and honesty). This conduct also 14 constitutes gross unfitness in violation of ORS 342.175(1)(c); OAR 584-020-0040(5)(c) 15 (Conviction of violating any federal, state, or local law.
