1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER 5 Teaching License 0f ) OF 6 BECKYANN WAGENBLAST ) PUBLIC REPRIMAND 7 8 On June 17, 2011, the Teacher Standards and Practices Commission (Commission) issued a 9 Notice 0f Opportunity for Hearing to Becky Ann Wagenblast (Wagenblast) in which the 10 Commission charged her with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584- 11 020-oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment), and 12 gross unfitness in violation of OAR 584-020-oo4o(4)(r).TI1e Notice was sent via U.S. First Class 13 Mail and U.S. Certified Mail Receipt 7010 2780 oooo 2187 6713 to the address on file with the 14 Commission. Neither the Certified mail nor regular mail were returned to the Commission and 15 are therefore assumed delivered. The Notice of Opportunity of Hearing, dated June 17, 2011, 16 and signed by Victoria Chamberlain, Executive Director, stated: 17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21—DAY PERIOD, 18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 23 DISCIPLINE.” 24 25 Wagenblast did not request a hearing. The Commission, therefore, finds Wagenblast to be in 26 default and enters the following findings of fact, conclusions of law and order, based on the files 27 and records of the Commission concerning this matter. 28 FINDINGS 0F FACT 29 1. Wagenblast has been licensed as a teacher in Oregon since October 24, 2007. Her Restricted 30 Transitional Teaching License, with a endorsements in Language Arts (HS), and Spanish 31 (ELE, MS, ML), issued on January 18, 2008, expired on October 24, 2010. Wagenblast also 32 held a Restricted Substitute Teaching License (PP-12), valid October 24, 2007, which 33 expired on October 24, 2010. During all relevant times Wagenblast was employed by the 34 Ione School District. 35 2. Between October 24, 2010, and December 2, 2010, Wagenblast taught with no form of 36 license from the Commission. During this time Wagenblast was unable to renew her license 37 because she had not completed the Civil Rights Knowledge requirement. Wagenblast was 38 informed of this requirement on at least three separate occasions, October 24, 2007, 39 January 18,2008, and June 19, 2008.
