l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter 0f the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION 6 GREGORY HUBER—MAYO'ITE ) OF RIGHT TO APPLY 7 8 On March 19, 2012, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Gregory Roger Huber-Mayotte (Mayotte) in which 10 the Commission charged him with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 11 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(5); OAR 584-020-0040(4)(0) as it 12 incorporates OAR 584-020-0035(3)(a), and Gross Unfitness in violation of ORS 342.175(1)(c); l3 OAR 584-020-0040(5)(c) and OAR 584-020-oo4o(5)(e). The Notice was sent via U.S. First 14 Class Mail and U.S. Certified Mail Receipt 7009 1410 0002 1925 3426 to the address on file with 15 the Commission. The Notice of Opportunity of Hearing, dated March 19, 2012, and signed by 16 Victoria Chamberlain, Executive Director, stated: 17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21eDAY PERIOD, 18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR l9 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 22 INCLUDE THE REVOCAT ION OR SUSPENSION OF YOUR LICENSE OR OTHER 23 DISCIPLINE.” 24 25 Huber-Mayotte did not request a hearing. The Commission, therefore, finds Huber- 26 Mayotte to be in default and enters the following findings of fact, conclusions of law and order, 27 based on the files and records of the Commission concerning this matter. 28 FINDINGS OF FACT 29 1. Huber-Mayotte was initially licensed as a teacher in Oregon on September 2, 2009. His 30 Initial I Teaching License, with endorsements in Basic Mathematics (HS, ML), General 31 Business (HS, ML), Integrated Science (HS, ML), and Multiple Subjects (MID LVL), issued 32 on September 2, 2009, was revoked by the Commission on January 6, 2012. 33 2. On June 17, 2011, Huber-Mayotte was convicted of Initiating a False Report (ORS 162.375), a class 34 C Misdemeanor, by entering a plea of guilty in the Clackamas County Circuit Court. 35 3i The conduct leading to Huber-Mayotte’s conviction was that he falsely reported to police the theft of 36 an aircraft, that he in fact had sold or traded to (2) two other separate parties, for debts Huber- 37 Mayotte owed them. The fraud, alleged by Huber-Mayotte’s actions surrounding the false report to 38 police regarding the aircraft and other similar incidents, remains contested in civil court and other 39 venues. PAGE 1-DEFAULT ORDER OF REVOCATION, RIGHT TO APPLY — HUBER-MAYOTTE, GREGORY ROGER 1 CONCLUSIONS 0F LAW 2 Huber-Mayotte’s conduct described in section two (2) above constitutes gross neglect of 3 duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584- 4 02o~0010(5) (Use professional judgment); OAR 584-020-0040(4)(o) as it incorporates OAR 5 584-020-0035(3)(a) (Maintain the dignity of the profession by respecting and obeying the law, 6 exemplifying personal integrity and honesty).This conduct also constitutes gross unfitness in 7 violation of ORS 342.175(1)(c); OAR 584-020-0040(5)(c) (Conviction of violating any federal, 8 state, or local law. A conviction includes any final judgment of conviction by a court whether 9 as the result of guilty plea, no contest plea or any other means). 10 Huber-Mayotte’s conduct described in section three (3) above constitutes gross neglect 11 of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 12 584-020-0010(5) (Use professional judgment).
