1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACT S AND 4 Educator License of ) FINAL ORDER OF g REBECCA FERN BEELER ) PUBLIC REPRIMAND 7 On February 18, 2014, the Commission received information from the 8 InterMountain Education Service District (IMESD) regarding Rebecca Fern Beeler 9 (Beeler). It was reported that Beeler may have violated professional standards by failing i 1O to provide 60 days’ notice of resignation as required by contract and State Law ORS 1 1 342-553(1)- 12 After review of the matters alleged, Beeler and the Commission agree that their 1 1 3 respective interests, together with the public interest, are best served by a stipulation to 14 certain facts and the imposition of a public reprimand. 1 5 By signing below, Beeler acknowledges, understands, stipulates, and agrees to the 16 following: (i) she has been fully advised of her rights to notice and a hearing to contest 1 7 the findings of fact, conclusions of law, and order set forth below, and fully and finally 1 8 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 19 Facts and Final Order of Reprimand (Stipulation and Final Older); (ii) this Stipulation 2O and Final Order is a public document and disclosed to the public upon request by the 21 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 22 approval and adoption by the Commission. If the Commission does not approve and 23 adopt this Stipulation and F inal Order, then neither Beeler nor the Commission are 24 bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, and 25 understands it completely; (v) she voluntarily, without any force or duress, enters into 26 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 27 Final Order below; (vi) she states that no promise or representation has been made to 28 induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an 29 attorney regarding this Stipulation and Final Order and has been fully advised with 30 regard to her rights thereto, or waives any and all rights to consult with an attorney prior 31 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 32 Final Order below. 33 STIPULATION OF FACTS 34 1. Rebecca Beeler has been licensed by the Commission since September 24, 2008. Beeler 35 holds an Initial School Psychologist License with an endorsement in School Psychologist Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - REBECCA FERN BEELER 1 (PP-12), valid from September 20, 2011, through September 18, 2015. During all relevant 2 times, Beeler was employed by the InterMountain Education Service District (IMESD). 3 2. On February 18, 2014, the Commission was notified by IMESD that Beeler may have l 4 violated professional standards by failing to provide 60 days’ notice of resignation as 5 required by contract and State Law ORS 342.553(1). 6 3. The Commission conducted an investigation and determined the following: 7 a. On July 12, 2013, Beeler signed a Probationary Licensed Employee Contract with 8 the InterMountain Education Service District for the 2013 — 2014 school year. 9 Under the Conditions of the Contract, the contract is binding unless the educator 10 gives 60 days written notice of termination to the district superintendent or be 1 1 1 subject to possible discipline as set forth under ORS 342.5530). i 12 b. On January 21, 2014, Beeler sent an email resignation to Leigh Nolte, the 1 3 Director of School Psychology and Behavioral Services. Beeler stated in her email, 14 “I believe it would be best if I resign effective immediately.” Following Beeler’s 1 5 resignation email, school officials reminded Beeler of the 60 day notice 1 6 requirement for teacher resignations under contract, State law, and rule. Beeler 1 7 had union representation available during her decision process, and elected to 18 resign without further notice.
