8 On December 9, 2010, the Teacher Standards and Practices Commission

9 (Commission) issued a Notice of Opportunity for Hearing to Amanda Lynn Requa
10 (Requa) in which the Commission charged her with Gross Neglect of Duty pursuant to
11 OAR 584-020-0040(4)(n), OAR 584-020-0010(4)(5), OAR 584-020-0040(4)(o), and
12 OAR 584-020-0035(2)(a). The Notice was sent via U.S. First Class Mail and U.S.
13 Certiﬁed Mail Receipt 7010 0290 0001 6831 4794 to the address on ﬁle with the
14 Commission. The Certified Mail was signed for on December 11, 2010. The regular
15 mail was not returned to the Commission. The Notice of Opportunity of Hearing, dated
16 December 9, 2010, and signed by Victoria Chamberlain, Executive Director, stated:
17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY
18 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED
l9 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR
20 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF
21 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN
22 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR
23 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE."

25 Requa did not request a hearing. The Commission, therefore, finds Requa to be in
26 default and enters the following findings of fact, conclusions of law and order, based on
27 the ﬁles and records of the Commission concerning this matter.
28 FINDINGS OF FACT
29 1. Amanda Lynn Requa has been licensed as a teacher in Oregon since May 14, 2009.
30 Requa’s Emergency Teaching License, issued on May 14, 2009, expired on June 14,
31 2009. During all relevant times Requa worked as a teacher at the City View Charter
32 School in the Hillsboro School District.

1 2. Beginning in August of 2008, Requa worked as a teacher at City View Charter School.
2 At the time of her employment Requa did not hold a teaching license or a charter school
3 registry. On May 11, 2009, Requa submitted an application to the Commission after
4 working during the 2008-2009 school year.
5 CONCLUSIONS OF LAW
6 Amanda Lynn Requas’ above described conduct constitutes gross neglect of
7 duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR
8 584-020-0010(5) (Use professional judgment); and OAR 584-020-0040(4)(o) as it
9 incorporates OAR 584-020-0035(2)(a) (Apply for, accept, offer, or assign a position of
10 responsibility only on the basis of professional qualiﬁcations, and will adhere to the
11 conditions of a contract or the terms of the appointment).
12 The Commission’s authority to impose discipline in this matter is based upon
13 ORS 342.175.
14 . FINAL ORDER
15 The Commission hereby suspends Amanda Lynn Requa’ right to apply for an
16 educator license for three months.
