1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of lhe ) STIPULATION OF FACTS 4 Teaching License of ) FINAL ORDER DENYING 5 ALBERT LO ) RIGHT TO APPLY AND AGREEMENT 6 ) NOT TO REAPPLY FOR LICENSE g On or about August 12, 2009, the Teacher Standards and Practices Commission 9 (Commission) referred Albert L0 (Lo) to investigation for his answers to questions on his 10 application for licensure. 11 After review ot the matters alleged, Mr. Lo and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and the denial or of Lo's right to apply for a license and his agreement not to reapply for a 14 license in Oregon. 15 By signing below, Lo acknowledges, understands, stipulates, and agrees to the 16 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 18 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, And Denial 19 of Right to Apply and Agreement Not To Reapply For a License (Stipulation and Final Order); (ii) 2O this Stipulation and Final Order is a public document and disclosed to the public upon request 21 by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 22 approval and adoption by the Commission. If the Commission does not approve and adopt this 23 Stipulation and Final Order, then neither Lo nor the Commission are bound by the terms herein; 24 (iv) he has fully read this Stipulation and Final Order, and understands it wmpletely; (v) he 25 voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents 26 to issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or 27 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he 28 has consulted with an attorney regarding this Stipulation and Final Order and has been fully 29 advised with regard to his rights thereto, or waives any and ail rights to consult with an attorney Page 1 STIPULATION OF FACTS AND DENIAL OF RIGHT TO APPLY ~ LO 1 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 2 Final Order below; (viii) Lo agrees not to reapply for teaching license in Oregon. 3 STIPULATION OF FACTS 4 1. On June 22, 2009, Lo signed and dated his Application for Educator License Form C-l 5 as part of the process to obtain an Oregon Teaching License. On this form Lo answered 6 “no” to question 1: “Ha ve you ever left any educational or school related employment, 7 voluntarily or involuntarily while the subject of an inquiry, review or investigation of 8 alleged misconduct or alleged violation of professional standards of conduct or when 9 you had reason to believe such investigation was imminent?‘ Lo resigned his 10 employment in the State of Texas while under investigation for alleged misconduct. 11 2. On June 22, 2009, Lo signed and dated his Application for Educator License Form C-1 12 as part of the process to obtain an Oregon Teaching License. On this form Lo answered 13 “no” to question 2: “Are you currently the subject of an inquiry, review or investigation for 14 alleged misconduct of alleged violation of professional standards of conduct?’ At the 15 time he signed the application, Lo was under investigation in the State of Texas while tor 16 alleged misconduct. 17 3. On June 22, 2009, Lo signed and dated his Application for Educator License Form C-1 18 as part of the process to obtain an Oregon Teaching License. On this form Lo answered 19 “no” to question 3: “Have you ever failed to complete a contract for educational services 20 in any educational or school related position, or for any alleged misconduct or alleged 21 violation of professional standards of conduct been placed on leave by your employer or 22 left such employment prior to the end of the contract term ?’ When he signed the 23 application Lo had been placed on administrative leave in the State ct Texas while under 24 investigation tor alleged misconduct. 25 4. Lo applied for employment in Oregon with the Salem-Keizer School District. As a part ct 26 that application process Lo completed character questions through the “Edzapp” system. 27 Lo answered “no” to the following questions: 28 a. Have you ever left any educational or school-related employment, voluntarily or 29 involuntarily, while the subject of an inquiry, review or investigation of alleged 30 misconduct or alleged violation ol professional standards of conduct? 31 b. Are you currently the subject of an inquiry, review or investigation for alleged 32 misconduct of alleged violation of professional standards of conduct?, and 33 c. Have you ever failed to complete a contract for educational services in any 34 educational or school related position, or for any alleged misconduct or alleged Page 2 STIPULATION OF FACTS AND DENIAL OF RIGHT TO APPLY - LO 1 violation of professional standards of conduct been placed on leave by your 2 employer or left such employment prior to the end of the contract term? 3 As described in paragraphs 1, 2, and 3 above, Lo had been placed on administrative 4 leave and resigned his employment while under investigation for alleged misconduct. 5 5. The Commission’s authority to impose discipline in this 22 matter is based upon ORS 342.175. w 23 .
