8 On November 29, 2011, the Teacher Standards and Practices Commission (Commission)

9 issued a Notice of Opportunity for Hearing to Craig Thomas Randall (Randall) in which the
10 Commission charged him with Gross Neglect of Duty pursuant to OAR 584-020-0040(4)(n), as
11 it incorporates OAR 584-020—0010(5); OAR 584-020~0040(4)(0) as it incorporates OAR 584-
12 O20-0035(2)(a); and OAR 584-020-0040(4)(r). The Notice was sent via U.S. First Class Mail
13 and U.S. Certified Mail Receipt 7011 2000 0001 1282 4609 to the address on file with the
14 Commission. Neither the Certified Mail nor the Regular Mail were returned to the Commission
15 and are assumed delivered. The Notice of Opportunity of Hearing, dated November 29, 2011,
16 and signed by Victoria Chamberlain, Executive Director, stated:
l7 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY
18 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED
19 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR
20 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU
21 FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER
22 OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF
23 YOUR LICENSE OR OTHER DISCIPLINE.”

25 Randall did not request a hearing. The Commission, therefore, finds Randall to be in default and
26 enters the following findings of fact, conclusions of law and order, based on the files and records
27 of the Commission concerning this matter.

29 FINDINGS 0F FACT
3O 1) Randall has been licensed as a teacher in Oregon since December 8, 2009. Randall’s current
31 Initial I Teaching License, with endorsements in Multiple Subjects and Language Arts,
32 issued on June 9, 2011, is valid until August l4, 2013. During all relevant times, Randall

33 was employed by the Knappa School District.

1 2) On September 7, 2009, Randall was hired as a teacher in the Knappa School District. This
2 position required a teaching license. Randall served in this position from September 7, 2009,
3 through December 8, 2009, without an Oregon teaching license.
4 CONCLUSIONS OF LAW
5 Craig Thomas Randall’s conduct described in paragraph 2 above constitutes gross neglect
6 of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR
7 584-020-0010(5) (Use professional judgment); OAR 584-020-0040(4)(o) as it incorporates OAR
8 584-020-0035(2)(a) (Apply for, accept, ojfer, 0r assign a position of responsibility only 0n the
9 basis of professional qualifications, and will adhere t0 the conditions 0f a contract 0/‘ the terms
10 of the appointment); and OAR 584-020~0040(4)(r) (Knowingly working without a license). The
11 Commission’s authority to impose discipline in this matter is based upon ORS 342.175.

13 FINAL ORDER
14 The Commission hereby imposes a Public Reprimand on the licensure of Craig Thomas
15 Randall.
