1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 431 In the Matter of the Educator ) DEFAULT ORDER OF 5 License of ) SUSPENSION 6 ASHLEY ANN PRIMEAU ) Z 9 0n January 28, 2015, the Teacher Standards and Practices Commission (Commission) issued 10 a Notice of Opportunity for Hearing to Ashley Ann Primeau (Primaeu) in which the Commission 1 l charged her with Gross Neglect of Duty. The Notice was sent via U.S. First Class Mail and U.S. 12 Certified Mail Receipt 7014 0150 oooo 1046 5420 to the address on file with the Commission. The 13 Notice designated the Commission file as the record for purposes of proving a prima facie case. The ‘ 14 Certified Mail receipt was returned “Unclaimed” to the Commission on March 11, 2015. The regular, 15 first class mail was not returned to the Commission and is assumed to have been delivered. The l6 Notice of Opportunity of Hearing, dated January 28, 2015, and signed by Victoria Chamberlain, l7 Executive Director, stated: 18 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DA'Y PERIOD, l9 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 20 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. IF 21 YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A HEARING, THE 22 COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY INCLUDE THE 23 REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE.” 2S Primeau did not request a hearing. The Commission, therefore, finds Primaeu to be in default and 26 enters the following findings of fact, conclusions of law, and final order, based on the files and 27 records of the Commission concerning this matter. 28 FINDINGS 0F FACT 29 1. Ashley Ann Primeau has been licensed by the Commission since July 6, 2011. Primeau holds an 30 Initial I Teaching License with endorsements in Basic Mathematics (HS, ML); General Business 31 (HS, ML); Marketing (HS); Middle School Science (ML); and Multiple Subjects (MIDLVL), valid 32 from July 6, 2011, through May 23, 2015. During all relevant times, Primeau was employed by 33 the Beaverton School District. 34 35 2. On March 29, 2012, the Commission received a report from the Beaverton School District 36 indicating Primeau had violated professional standards involving testing improprieties in the 37 course of an Oregon Assessment of Knowledge and Skills (OAKS) test Primeau administered. 38 District and Commission investigations determined that on or about February 29, 2012, and l 39 March 1, 2012, Primeau improperly assisted students taking the OAKS math test in violation of PAGE 1-DEFAULT ORDER OF SUSPENSION- ASHLEY ANN PRIMEAU 1 testing protocols. Specifically, Primeau improperly and repeatedly assisted students by providing 2 answers; writing out the problems; indicating what math function to use; indicating what math 3 formula to use; telling the student(s) t0 find the area, radius, common denominator; drawing out 4 examples; and other forms of inappropriate help t0 multiple students. Investigation determined 5 Primeau had been properly trained to administer the test, and Primeau signed the “Test 6 Administrator Assurance of Test Security” form indicating she understood testing protocol and 7 requirements. As a result of Primeau’s actions, fifty three students had their test scores 8 invalidated. During the course of the investigation, Primeau was not forthcoming and 9 equivocated her responses to questioning. 10 ll CONCLUSIONS OF LAW l2 Primeau’s conduct described above, constitutes gross neglect of duty in violation ORS 13 342.175(1)(b); OAR 584-02o-oo4o(4)(n) as it incorporates OAR 584-020-0010(2)(Encourage 14 scholarship), OAR 584-020-0010(4)(Raise educational standards), OAR 584-020-001o(5) (Use 15 professional judgment), OAR 584-020-0025(2)(e) (Using district lawful and reasonable rules and 16 regulations); OAR 584-020-oo4o(4)(c) (Falsification of any document or knowing l7 misrepresentation directly related to licensure, employment, or professional duties); and OAR 584- 18 o20-oo4o(4)(o) as it incorporates OAR 584-020-0035(3)(a)(Maintain the dignity of the profession l9 by respecting and obeying the law, exemplifying personal integrity and honesty). 20 21 The Commission's authority to impose discipline in this matter is based upon ORS 342.175. 22 23 FINAL ORDER 24 25 The Commission hereby suspends Ashley Ann Primeau’s licensure for a period of ninety (90) 26 days, to begin upon the date this order is signed and in effect. 27 IT IS SO ORDERED THIS 075A’ day of March, 2015. 28 TEACHER STANDARDS AND PRACTICES COMMISSION , .
