I BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER 5 Teaching License of ) ONE (1) YEAR 6 l SUSUPENSION OF RIGHT TO 7 JACOB RIVER WREN ) APPLY FOR TEACHING LICENSE 8 9 On September 21, 2011, the Teacher Standards and Practices Commission (Commission) 10 issued a Notice of Opportunity for Hearing to Jacob River Wren (Wren) in which the 11 Commission charged him with Gross Neglect of Duty and Gross Unfitness pursuant t0 ORS 12 342.175(1)(b); OAR 584-02o-oo4o(4)(n) as it incorporates OAR 584-020-001o(5); OAR 584- 13 020-004o(4)(o) as it incorporates OAR 584-020-0035(1)(c)(D), OAR 584-020-0035(3)(a); and 14 OAR 584-020-0040(5)(e). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail 15 Receipt 7010 2780 0000 2187 7017 to the address on file with the Commission. The Notice of 16 Opportunity of Hearing, dated September 21, 2011, and signed by Victoria Chamberlain, l7 Executive Director, stated: l8 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, 19 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 2O FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 21 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 22 HEARING, THE COMMISSION \NILL ADOPT AN ORDER OF DEFAULT WHICH MAY 23 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 24 DISCIPLINE.” 25 26 Wren did not request a hearing. The Commission, therefore, finds Wren t0 be in default and 27 enters the following findings of fact, conclusions 0f law and order, based on the files and records 28 of the Commission concerning this matter. 29 FINDINGS OF FACT 30 1. Wren has been licensed as a teacher in Oregon since September 22, 2010. His current 31 Career and Technical Education I License, with an endorsement in Manufacturing 32 Technology (HS), issued on September 22, 2010, and valid until September 22, 2011, is 33 expired, During all relevant times, Wren was employed by the Roseburg School District. 34 2. During the 2010/ 2011 school year, Wren failed a pre-employment drug test, having used marijuana. 35 Wren was employed, nonetheless, under condition that Wren submit to random drug screenings. 36 Wren used marijuana over the winter break, and subsequently refused the random drug screening, 37 advising school officials that he would likely fail the test due to recent use. While employed with the Roseburg School District, two female students reported that Wren touched 2 them inappropriately in class. Following a district investigation, it was determined that Wren 3 utilized physical contact and physical proximity that caused students to feel uncomfortable. 4 CONCLUSIONS 0F LAW 5 Wren’s conduct described in section two (2) above constitutes gross neglect of duty in 6 violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020- 7 0010(5) (Use professional judgment) ; OAR 584-020-0040(4)(o) as it incorporates OAR 584- 8 020-0035(3)(a) (Maintain the dignity 0f the profession by respecting and obeying the law, 9 exemplifying personal integrity and honesty); This conduct also constitutes gross unfitness in 10 violation of ORS 342.175(1)(c); OAR 584-020-0040(5)(e) (Admission 0f or engaging in acts 11 constituting criminal conduct, even in the absence of a conviction). 12 Wren’s conduct described in section three (3) above constitutes gross neglect of duty in 13 violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020- 14 0010(5) (Use professional judgment); and OAR 584-020-0040(4)(0) as it incorporates OAR 15 584-020-0035(1)(c)(D) (Honoring appropriate adult boundaries with students in conduct and 16 conversations at all times). 17 The Commission’s authority to impose discipline in this matter is based upon ORS 18 342.175. 19 FINAL ORDER 20 The Commission hereby suspends Jacob River Wren’s right to apply for a teaching 21 license in Oregon for a period of one (1) year, to begin upon the date this order is signed and in 22 effect. 7'11, 23 IT IS SO ORDERED THIS day Oprril, 2012. 24 TEACHER STANDARDS AND PRACTICES COMMISSION 25 / 27 B 1 1/11 _ [2011.21.11 28 ictoria Ch.m l - in, ecutive Director 29 3O NOTICE OF APPEAL OR RIGHTS 31 32 YOU ARE ENTITLED TO JUDICIAL REVIEW OF THIS ORDER.
