8 On or about January 19, 2016, the Teacher Standards and Practices

9 Commission (Commission) received a report from the Klamath Falls City School
1O District indicating that Emily Christine Haney (Haney) was suspected of violating
1 1 District Policies and Professional Standards.
12 After review of the matters alleged, Haney and the Commission agree that
13 their respective interests, together with the public interest, are best served by a
14 stipulation to certain facts, the imposition of a public reprimand of her Oregon
15 educator license, followed by two (2) years of probation.
16 By signing below, Haney acknowledges, understands, stipulates, and
17 agrees to the following: (i) she has been fully advised of her rights to notice and a
18 hearing to contest the findings of fact, conclusions of law, and order set forth
19 below, and fully and finally waives all such rights and any rights to appeal or
20 otherwise challenge this Stipulation of Facts and Final Order of Reprimand and
21 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a
22 public document and disclosed to the public upon request by the Commission;
23 (iii) this Stipulation and Final Order is contingent upon and subject to approval
24 and adoption by the Commission. If the Commission does not approve and adopt
25 this Stipulation and Final Order, then neither Haney nor the Commission are
26 bound by the terms herein; (iv) she has fully read this Stipulation and Final
27 Order, and understands it completely; (v) she voluntarily, without any force or
28 duress, enters into this Stipulation and Final Order and consents to issuance and
29 entry of the Stipulated Final Order below; (vi) she states that no promise or
30 representation has been made tn induce her tn sign this Stipulation and Final
31 Order; and (vii) she has consulted with an attorney regarding this Stipulation and
32 Final Order and has been fully advised with regard to her rights thereto, or
33 waives any and all rights to consult with an attorney prior to entering into this

2 below. Haney understands that the probation will he. subject to specific. terms
3 and conditions.
4 STIPULATION OF FACTS
5 1. The Commission has licensed Emily Haney since July 10, 2012. Haney’s
6 Tnitial I Teaching license, with endorsements in Elementary-Multiple
7 Subjects (PK-12) and English to Speakers of Other languages (PK-12), is
8 valid from July 14, 2015, through July 13, 2018. During all relevant times,
9 Haney was employed by the Klamath Falls City School District.
10 9. On January 19, 9016, the Commission received information from the
11 IGamath Falls City Schools indicating Haney may have committed acts
12 which constitute gross neglect of duty. Investigation determined that on
13 January 8, 2016, at approximately 1:17 PM, Roosevelt Elementary School
14 Principal Ruth Krieger observed Haney’ in her classroom and in the
15 presence of students; with glazed eyes, flushed skin, slut-ring her words,
16 and smelling of alcohol.
17 Haney admitted t0 having a history of alcohol abuse and admitted t0
1B consuming alcnhnl prior tn coming tn work that day. Haney was placed on
19 administrative leave and later resigned her employment.
20 3. Haney sought and completed comprehensive treatment for alcohol abuse
21 and has established approximately 17 months of continued sobriety.

23 programs related to her ongoing sobriety.

1 CONCLUSION OF LAW
2 Haney was under the influence of alcohol while on duty and on school
3 property as described above. This conduct constitutes gross neglect of duty in
4 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR
5 584-020-0010(5) (Use professional judgment), OAR 584-020-0025(2)(e) (Using
6 district lawjiil and reasonable rules and regulations); and OAR 584-020-
7 0040(4)(g) (Appearing on duty or at any district-sponsored activity while
8 under the influence of alcohol or any controlled substance).

10 The Commission’s authority to impose discipline in this matter is based
11 upon ORS 342.175.
1 2 ORDER
13 The. Commission hereby adopts and incorporates herein the above
14 findings 0f fact, conclusions of law, and based thereon hereby imposes a Public
15 Reprimand on Emily Christine Haney’s Oregon educator license upon adoption
1 6 of this order.
17 Furthermore, the Commission shall impose two (9} years of probation
18 upon Haney to commence the date of adoption of this order and subject to the
19 following terms and conditions of probation:

21 1_ Haney will participate and/or continue to participate in any treatment
22 recommendations and recovery programs as recommended by her
23 treatment providers (if any).
24 2. Haney will, during the first year of probation, report in writing to
95 Commission staff every sir months on the status of her sobriety This
26 may include documentation from Haney’s counselor, 12 step program,
27 sponsor, or other recovery support person.
28 3. Haney will comply with the Standards for Competent and Ethical

1 Violation of any term or condition of probation shall constitute an independent
