11 On September 26, 2001, the Teacher Standards and Practices Commission issued a
12 Notice of Opportunity for Hearing to Craig Clemrner, in which the Commission proposed to
13 suspend or revoke the teaching license of Craig Clemmer or otherwise impose discipline
14 under ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. Certified Mail
15 Receipt #7000 0600 0023 8496 9907 to the Santiam Correctional Institution where Craig
16 Clemmer is an inmate. The notice sent via certified mail was returned to the Commission on
17 October 1, 2001, signed by Sgt. Keepers‘ Craig Clemmer did not request a hearing.

119 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive
‘20 Director, stated:
21 If a request for hearing is not received within this 21-day period, your right to ‘
22 hearing shall be considered waived unless your failure to request a hearing was
23 beyond your reasonable control. If you do no request a hearing or if you fail to
24 appear at a hearing, the Commission will adopt an Order of Default which may
25 include the revocation or suspension of your license or other discipline.

27 Based on the foregoing, the Commission finds Craig Clemmer in default and such
28 default is hereby entered. Based on the records and files of the Commission, the '
29 Commission enters the following findings of fact and order.

33 l. Craig Stephen Clemmer holds a Basic Teaching License with an endorsement in
34 Basic Physical Education valid from December l, 1998, through October ll, 2002.

. 2 2. Craig Stephen Clemmer was employed by Culver School District at Culver
3 Elementary School since October 1994. On March 20, 2001, Clemmer was placed on paid
4 administrative leave that continued until April 13, 2001 , when he was arrested. On April
5 16, 2001, Clemmer was placed 0n unpaid administrative leave.

7 3. On April 13, 2001, Madras Police arrested Craig Clemmer for four counts of
8 Sexual Abuse in the First Degree. ORS 163.427

10 4. On September 12, 2001, Craig Stephen Clemmer was convicted in the Circuit
11 Court of the State of Oregon for the County of Jefferson for the following crimes:
12 ORS 163.415 — Sexual Abuse in the Third Degree (five counts)
13 ORS 163.427 — Attempted Sexual Abuse in the First Degree _
14 ORS 163.41 1 — Attempted Unlawful Sexual Penetration in the First Degree

1/ CONCLUSIONS 0F LAW
18 The Commission is required under ORS 342.175(2) and OAR 584-020-0040(1) to
19 revoke the teaching license of any person convicted of a violation or an attempted violation
20 ofORS 163.415, 163.427 or 163.411.

24 The Commission revokes the Oregon Basic Teaching License #282845, issued to
25 Craig Stephen Clemmer, DOB 10-11-54.
