METTEE ) ORDER OF REVOCATION Lucimp-‘iLLJ 6 On February 16, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from Marilyn McGlasson, Superintendent, Banks School District, indicating 8 that Jerome G. Mettee (Mettee), had been charged by the Forest Grove Police Department for 9 making a false police report. 10 Mr. Mettee fully cooperated with the Commission's investigation. After review of the 1 1 matters alleged, Mr. Mettee and the Commission agree that their respective interests, together 12 with the public interest, are best served by a stipulation to certain facts and voluntary surrender 13 of his teaching license as per OAR 584-050-0027, 14 This Order sets forth the facts upon which the parties have agreed and the sanction to ' be imposed. Mr. Mettee stipulates that there are sufficient facts contained in the Commission's 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Mettee waives the right to a hearing to contest the finding of 18 fact, conclusion of law and order set forth below. Mr. Mettee understands that the Commission 19 will revoke his teaching license effective August 5, 2005. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Mettee nor the 22 Commission are bound by these Stipulations and Mr. Mettee retains all rights to a hearing on 23 the allegations. 24 STIPULATION OF FACTS 25 1. Mr. Mettee holds a Basic Teaching License valid January 29, 2004, through 26 January 31, 2007, with endorsements in Basic Health Education and Basic Physical Education. O Page 1 STIPULATION OF FACTS, SURRENDER AND ORDER OF REVOCATION - METTEE 1 2. Mr. Mettee was employed by Banks School District from August of 1985 through .2 June of 2005. On March 14, 2005, Mr. Mettee notified the District that he would not be returning 3 for the 2005-2006 school year. 4 3. Mr. Mettee received positive teaching evaluations during his 2O year service as a 5 middle school teacherfor Banks School District. 6 4. On December 2, 1994, Mr. Mettee falsely reported to Hillsboro Police Department 7 that he was physically assaulted in the parking lot at Tualaity Hospital. 8 5. On October 6, 1999, Mr. Mettee falsely reported to Banks Police that he saw a man 9 with a gun in the parking lot of Banks Junior High School. The school was locked down and law 10 enforcement from Washington County responded. On February 9, 2005, Mrt Mettee admitted to 11 Forest Grove Police that he made up the incident regarding the gunman on school campus at 12 Banks School District in 1999. 13 6. On February 1, 2005, Mr. Mettee falsely reported to the Forest Grove Police . Department that he was assaulted by two men and stabbed during a robbery attempt. 15 7. On April 18, 2005, Mr. Mettee was convicted for initiating a False Report in the Circuit 16 Court of the State of Oregon for Washington County. The court sentenced Mr. Mettee to two 17 years probation, 120 hours community service and ordered him to not use 911, unless a true 18 emergency. Mr. Mettee was also ordered to seek counseling and to remain in counseling until 19 his counselor and Probation Officer give him permission to terminate. 20 8. Mr. Mettee voluntarily sought treatment from a mental health provider prior to the 21 court order. 22 IT IS SO STIPULATED: 23 QHQQZ éW é’d0’0f 24 Jéréme G. Mettee Date 25 WWW wavy 26 Victoria Cha erlain, Executive Director Date a Teacher Standards and Practices Commission Page 2 STIPULATION OF FACTS, SURRENDER AND ORDER OF REVOCATION - METTEE 1 CONCLUSIONS OF LAW ' Mr. Mettee’s engagement in criminal behavior and conviction for Initiating False Report 3 are violations of OAR 584-020-0040(5)(c) and OAR 584-020-0040(5)(e). This conduct 4 constitutes Gross Unfitness. The Commission’s authority t0 impose discipline in this matter is 5 based upon ORS 342.175. 6 ORDER F 7 The Commission accepts the voluntary surrender of Jerome G.
