1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON :31 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION OF 6 THOMAS ALFRED PEREZ ) RIGHT TO APPLY FOR LICENSURE 7 8 On September 28, 2007, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Thomas Alfred Perez (Perez) in which the Commission 10 charged her with misconduct under ORS 342.175. The Notice was sent via U.S. First Class Mail and 11 U.S. Certified Mail Receipt 7006 0810 0001 4602 1661 to the address Mr. Perez provided to the 12 Commission. The certified mail receipt was returned unclaimed to the Commission on October 2, 13 2007. The U.S. First Class Mail was returned to‘ the Commission on October 2, 2007. The Notice of 14 Opportunity of Hearing, dated September 28, 2007, and signed by Victoria Chamberlain, Executive 15 Director, stated: 16 "You, Thomas Alfred Perez, are entitled to a hearing on the proposed action of the 17 Commission. If you want a hearing, you must file a written request for a hearing with 18 the Commission within 21 days of the date of this notice. Attached to this notice is a 19 copy of the procedures, right of representation and other rights of parties relating to the 20 conduct of a hearing as required under ORS 183.413(2).” :2 Mr. Perez did not request a hearing. The Commission, therefore, finds 23 Mr. Perez to be in default and enters the following findings of tact, conclusions of law and 24 order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. On March 16, 2005, the Commission received information alleging Mr. Perez violated of 27 Standards for Competent and Ethical Performance of Oregon Educators, OAR 584, Division 20. 28 2. The Commission informed Mr. Perez of these allegations in 2005 and requested that he 29 participate in the investigation by responding to the Commission's request for information. Notices 30 were sent to Mr. Perez by standard and certified mail. Neither were returned and therefore presumed 31 received. PAGE 1 — DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY — PEREZ 1 3. Mr. Perez failed to respond to the Commission’s requests for information. This misconduct 2 constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(p). 3 CONCLUSIONS OF LAW 4 Mr. Perez’ failure to respond to the Commission's requests for information constitutes Gross 5 Neglect of Duty in violation of OAR 584-020-0040(4)(p).
