1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER OF 5 NANCY ANN ARFORD-TASKER ) REPRIMAND AND PROBATION g On January 28, 2009, the Teacher Standards and Practices Commission (Commission) 8 received a C-1 application for educator license from Nancy Ann Arford-Tasker (Arford-Tasker) 9 upon which she failed to disclose a conviction. 1O After review of the matters alleged, Ms. Arford-Tasker and the Commission agree that 1 1 their respective interests, together with the public interest, are best sewed by a stipulation to 12 certain facts and the imposition of a reprimand and probation. 13 By signing below, Ms. Arford-Tasker acknowledges, understands, stipulates, and agrees 14 to the following: (i) she has been fully advised of her rights to notice and a hearing to contest 15 the findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 16 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Order of 17 Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a 18 public document and disclosed to the public upon request by the Commission; (iii) this 19 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 20 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 21 then neither Ms. Arford-Tasker nor the Commission are bound by the terms herein; (iv) she has 22 fully read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, 23 without any force or duress, enters into this Stipulation and Final Order and consents to 24 issuance and entry of the Stipulated Final Order below; (vi) she ‘states that no promises or 25 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) 26 she has consulted with an attorney regarding this Stipulation and Final Order and has been fully 27 advised with regard to her rights thereto, or waives any and all rights to consult with an attorney Page 1 STIPULATION OF FACTS ORDER OF REPRIMAND AND PROBATION - ARFORD-TASKER 1 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 2 Final Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Ms. Arford-Tasker since April 26, 1993. Ms. Artord» 5 Tasker holds a Standard Teaching License, with an endorsement in Standard 6 Elementary issued October 7, 2003. Ms. Arford-Tasker submitted an application to 7 renew her license on January 28, 2009. 8 2. 0n November 14, 2005 Ms. Arford-Tasker was arrested and subsequently convicted of 9 Driving Under the Influence of Intoxicants, while on her way to pick-up her minor 10 daughter from the airport. 11 3. Date 20 Teacher Standards and Practices Commission 21 CONCLUSION OF LAW 22 Ms. Nancy Ann Arford-Tasker failed to disclose a conviction on her application for 23 educator Iicensure. This conduct constitutes Gross Neglect of Duty in violation of OAR 584- 24 020-0040(4)(c). The Commission's authority to impose discipline in this matter is based upon 25 ORS 342.175. 26 /// 27 /// 28 /// 29 lll Page 2 STIPULATION OF FACTS ORDER OF REPRIMAND AND PROBATION - ARFORD-TASKER 1 ORDER 2 The Commission adopts and incorporates herein the above findings of fact and 3 conclusions of law, and based thereon, imposes a Public Reprimand on Nancy Ann Arford- 4 Tasker. This Stipulation of Facts, Order and Probation constitute the Reprimand. 5 Furthermore, the Commission places Ms. Arford-Tasker on Probation for a period of four 6 (4) years, subject to the following terms and conditions: 7 1. Ms. Arford Tasker shall, at her own initiative and expense, obtain counseling by a 8 mental health professional acceptable to the Commission to explore issues regarding 9 candor in accepting responsibility related to alcohol and driving. A minimum of six 10 (6) one-hour sessions should be completed. 11 2. During the period of this probation, Ms. Arford-Tasker shall submit to the Executive 12 Director of the Commission reports of her compliance with this counseling 13 requirement. She shall provide these reports after the first three sessions and again 14 after the next three sessions, all of which must be completed within the first twelve 15 months of her probation. 16 3.
