1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION Q OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License 0f ) ORDER OF REPRIMAND AND 5 MARY LYNN BOND ) PROBATION 6 On April 19, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from David J. Davis, Superintendent, Klamath County School District 8 indicating that Mary Lynn Bond (Bond) appeared on duty under the influence of alcohol. 9 Ms. Bond fully cooperated with the Commission's investigation. After review of the 1O matters alleged, Ms. Bond and the Commission agree that their respective interests, together 11 with the public interest, are best sewed by a stipulation to certain facts, the imposition of a 12 public reprimand followed by a four (4) year probation. This Order sets forth the facts upon 13 which the parties have agreed and the sanction to be imposed. Ms. Bond stipulates that there 14 are sufficient facts contained in the Commission’s files and records to support the findings of Q fact and conclusions of law set forth below. In entering into this stipulation, Ms. Bond waives 16 the right to a hearing to contest the findings of fact, conclusion of law and order set forth below. 17 Ms. Bond understands that the probation will be subject to specific terms and conditions. 18 STIPULATION OF FACTS 19 1. Ms. Bond has been licensed by the Commission since November 13, 1990. 20 Ms. Bond currently holds a Standard Teaching License valid June 10, 2002, through June 21, 21 2007, with an endorsement in Standard Elementary. 22 2. Ms. Bond began her employment with the Klamath County School District on 23 August 29, 1994. 24 3. On April 8, 2005, District staff report that Ms. Bond appeared to be under the 25 influence of influence of alcohol on duty. 26 4. Ms. Bond recognizes that she has an alcohol dependency problem and is completing ‘I a treatment program at Lutheran Community Services Northwest, in Klamath Falls, Oregon. Page 1 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - BOND 1 Ms. Bond enters into this Stipulation of Facts with the knowledge that the Commission .2 shall place her on probation for a period of four (4) years. This Stipulation is contingent upon 3 approval and adoption of the Order by the full Commission. lfthe Commission does not adopt 4 this Order, neither Ms. Bond nor the Commission are bound by these stipulations and Ms. Bond 5 retains the right to a hearing on the allegations. 6 IT IS SO STIPULATED: " 7 was A“ M 8 Ma a rufi'hr': Date 9 - if/LA mam-arr 10 ictoria W'.‘ ain, Executive Director Date 11 Teacher Sta dards and Practices Commission 12 CONCLUSIONS OF LAW 13 By appearing on duty under the influence of alcohol on April 8, 2005, Mary Lynn Bond 14 violated OAR 584-020-0040(4)(g). This misconduct constitutes Gross Neglect of Duty. The ‘ Commission's authority to impose discipline in this matter is based upon ORS 342.175. 16 ORDER 17 The Commission imposes a Public Reprimand upon Ms. Bond. The Stipulation of Facts, 18 Order and subsequent Probation constitutes the Reprimand. 19 Furthermore, the Commission imposes a four (4) year probation upon Ms. Bond to 20 commence the date 0f adoption of this order and subject to the following terms and conditions of 21 probation: 22 1. Ms. Bond shall, at her own initiative and expense, continue to obtain treatment for her 23 alcohol dependency as recommended by her alcohol treatment provider and abstain from the 24 consumption of alcohol; 25 2. During the period of this probation, Ms. Bond shall submit to the Executive Director of 26 the Commission reports of her compliance with the aftercare treatment plan. Ms. Bond shall ' provide these reports every six (6) months during her probation, on or before: May 4, 2006; Page 2 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - BOND 1 November 4, 2006; May 4, 2007; November 4, 2007; May 4, 2008; November 4, 2008; May 4, .2 2009; and November 4, 2009. 3 3. Ms. Bond shall report in writing within ten days to the Executive Director of the 4 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or criminal 5 probation; and 6 4.
