On ll March 18. 1996, TSPC requested a written explanation from Hollamon on the 1995 l2 arrest which he submitted on March 126= 1996. On May l7, 1996 TSPC considered 13 the materials submitted by Hollamon and authorized the Executive Secretary to enter g 14 into a stipulated of Facts and Order of Probation as a resolution of this case. 15 STIPULATION OF FACTS , 16 it was determined that the stipulation of the following facts is in the best interest of 17 'Jefl'rey Paul Hollamon. the Commission. and the public. 18 1. 0n February 26. 1996. Jefi'ey Paul Hollamon submitted an application for an , 19 Oregon Teaching License. 720' 2. Hollarnon answered "yes" to Character Question 10, "Have you ever entered a 21 - plea of guilty or Nolo Contenders relative to any charge of misdemeanor. felony. 22 or major traflio violation?". Hollamon submitted his explanation and the 23 certified court documents. 24 3. Hollamon was charged with one count of Assault IV and one count of 25 Harassment in September 1995. 26 4. On January 16. 1996. Hollamon accepted the Washington County District 27 Attorney's ofier to plea no contest to the Harassment charge with the 28 understanding that the Assault IV charge would be dismissed. 29 5. On January 16, 1996, Hollamon was convicted of Harassment in Washington 30 County District Court, was given a 2 year probation with condition that 31 Hollarnon complete anger counseling, and complete 20 hours of community 32 service to be completed in a period of 6 months. 33 6. On August 29, 1996, Hollamon and the injured party entfl'ed a Civil 34 Compromise Agreement in order for Hollamon to pursue a career in education. 35 7. Based upon this agreement, the Washington County Circuit Court set aside the 36 harassment conviction, thus terminating the probation. 1 in entering this Stipulation J cfli'ey Paul Hollamon understands that the Commission q will authorize issuance of a Basic Teaching License with Language Arts endorsement and place him on probation for a period of two years from the date of the order. This 4 Stipulation and proposed Order are contingent upon approval by Jeffrey Paul 5 Hollamon and the full Commission. Under ORS 342.175 and OAR 584. Division 17 20, the Commission may suspend or revoke the license and educator who was 18 convicted of a crime when such crime has a bearing on the person's ability to fulfill 19 the responsibilities of a licensed position. In that this incident occurred on school 20 property, at a school-sponsored activity, and in the presence of school—age children. 21 the incident is deemed relevant to licensure. Parents and the public expect educators 22 to serve as good role models as law abiding citizens. The fact that Mr. Hollamon has 23 entered a compromise agreement to have the conviction set aside does not alter the 24- relevance of the incident for licensure. 25 ULTIMATE FINDINGS or FACT 1 26 On January 16.1996. Jefirey Paul Hollamon pled no contest to the charge of 27 Harassment in Washington County District Court. On August 29, 1996. Hollamon's 28 please of "no contest" was set aside by the Washington County Circuit Court based 29 upon a civil compromise agreement with the injured party. ' . ORS 670.280 4 requires the Commission to consider the relationship of the conviction to fitness to 5 serve as an educator. 6 ORDER 7 The Teacher Standards and Practices Commission approves issuance of an OregOn 8 TeaCthg License to Jefi-ey Paul Hollamon and places him on probation for a period of 9 two years. During this probation Hollamon shall: l) document completion of the 10 anger counseling required by Washington County District Court; and 2) conduct 11 himself as a. law abiding citizen.
